My ex who pays child support has recently got arrested, and it is likely that that he will be going to prison for a few years. How will this effect my child support ? Will they allow work release, or am I just S.O.L?

He can't pay while he is in jail, obviously. When he comes out, he is in arrears. He keeps dragging the payment, you get his @$$ back in jail.

You are entitled to whatever money he may get from work (sick leave, vacation, etc.) while he is in jail.

Some women don't want to do it, but in fact these men are abusing their children, ignoring their obligations, and, honey, in all honesty if he is not going to pay anyway, I'd have him in jail for it.

Better advice yet: Get an education, if you do not have one. So you can get a better paying job, and do not depend on his little mind control games, and he can't have you tied up like this. Then when he comes with the money you can just tell him to shove it where the Sun don't shine.

What a drag....I mean for your children. You won't be able to collect cause he won't have an income. It will however add up and he'll owe you and then some. But unfortunately that doesn't help the kids now.. You could however if extra income is needed contact your local Social Services and see about getting assistance with them. You won't be responsible for paying it back, he will as he's the absent parent.

You answered the question yourself. If he goes to prison, he isn't making money at what ever job he was holding down before he got busted. That means, he has no income so, he cant pay. If he isn't getting paid, he isn't going to be able to send money.

check with your state as to what action you can take, but hey, the old saying, " cant get blood out of a turnip" means if he isn't got it, you cant get it.

You do but you don't. Needless to say, since he is in jail, he probably won't be sending any support. However, the arrears will continue to accrue and you can collect on those literally - FOREVER. The arrears NEVER go away.
