My "roommate" and I got into a fight in which she tried to stab me with a knife. I called the cops, but I didn't want to press charges. The police pressed charges anyway and charged her with aggravated assault. I would like to know what is going to be done to her? I really dont want her to go to jail.....

normally when their is a fight an a weapon is allegedly used they will arrest ..the prosecutors office decides if they want to go to court on it, but their all allot of factors they consider...(1)weather the defendant (your friend) has a criminal history and what for (Priors)(2) they will consider weather they (prosecution) can get a conviction (3) if you don not wish to testify they cannot compel you...most likely if no one was injured
they will lower the charges..and try to get defendant to plead guilty to a lessor offense....I'd tell your friend not to plea to anything unless it is a misdemeanor and is adjudicated without time having to be served and minimal probation

Aggravated assault = Not less than 1 nor more than 20 years, with the following exceptions:

-Agg assault on a Peace Officer on duty = not less than 5 nor more than 20 years (includes Correctional Officers)
-Agg assault against anyone 65 years old or older = not less than 3 nor more than 20 years
-agg assault in a public transit station = not less than 3 nor more than 20 years
-shooting at someone from inside a motor vehicle (drive by) = not less than 5 nor more than 20 years
-agg assault using a gun against student/teacher/in a school zone = not less than 5 nor more than 20 years
-agg assault against family/ex-spouse = not less than 3 nor more than 20 years

So...in your situation, it looks like not less than 1 nor more than 20 years if convicted. Of course, there may be a plea bargain offered...maybe to include Probation, etc....

Depend on how lenient the judge is with you, when he sentences you.It could be probation, or it could mean a few years in the pokey.
