while entering access road onto private property i hit a guard rail that was sticking out from a previous accident, owners do not insist on ticket. guard rail is illegal,road hazzard

When you are driving a vehicle and cause any damage you can be fined by the police, even on private property.

A police officer can issue a ticket for just about anything, whether the ticket is honorable is another question. The guard rail probably belongs to the county / city where it is located and it does not matter if it is on or near the right of way to private property. If the guard rail is public property a ticket can be issued. Any time public property (in your case the guard rail) is damaged a ticket is usually issued to show who should pay to have the property fixed and the liability will not fall back on the tax payers. If the guard rail was already damaged take some pictures, get someone to write out something stating that it had been previously damaged and never fixed, plea not guilty on your ticket and show up in court. More than likely you will get out of it with court costs, if that. Good luck.

I agree. The guard-rail is public property, so the officer is correct. It belongs to the state dept. of transportation. Other reasons a ticket can be issued on private property is if there is significant damage (also may apply to your situation) or if the accident is a hit-n-run.

If the gaurd rail is public property then yes. If the private property owners want a ticket given then yes. Other then that I don't know.
