I am in need of advice regarding overstay. I had completed six years of my h1b in US and overstayed it by 4 months and 15 days. Now i've come back to chennai to apply for b1 visa thru my new employer. What are the questions i should be prepared for and what kind of documents i should have

i've the paystubs until march'06 and my last 2 years tax returns, and would the visa officer accept if i mention that i overstayed due to my greencard expectations, and that i was waiting to start my greencard processing which got delayed at the end.

Be prepared for a denial.

You will need to explain honestly why you overstayed your visa.

Here are the questions that might be posed...

Did you work with an expired visa? Yes=Denial.
Did you have any problems with the police? Yes=denial.
Do you have a girlfriend in the US? Yes=Denial

Basically, a consular officer will be afraid that you are planning on going to America and finding a job. Hence bypassing the H1B process.

Look, it is easier for a Consular Officer to deny rather than approve visas. An overstay makes more work for consular officers, there is no reason for taking the easy way out through a 214(b) denial.

214(b) is going to be your major hurdle, you need to prove that you are not an intending immigrant.
