I got a second DUI within a few months of each other thank-you to being on a methadone program. I feel I am being harrassed by police because they know I am on Methadone and thats the only reason they stop me, they know it will stick! I was not impaired as they say, cops lie,lie lie! If given the proper dose of methadone it doesn't impair you! How do I fight it? I honestly don't feel I deserve this second DUI,just got ma cop who likes to be MR. Tough Guy on my back!

Methadone if given a propper dose of it and you are on Methadone maintiance it does not affect people like you think!
You don't get the high off methadone like everyone thinks! Before you shoot it down and critisise it, research it! No I was not driving under alchole! My first DUI was also because of Methadone. The clinic I dosed at said it was ok to drive! They have a medical Dr. that monitors us to make sure we are not on to high a dose, I encourage everyone to do some research on the subject! If infact I do get convicted does that mean my clinic could be liable for letting me drive intoxicated? They infact said I was safe to drive!

First, let me explain what harassment is. The following is from the criminal laws of my State:
(a)(1) HARASSMENT. A person commits the crime of harassment if, with intent to harass, annoy, or alarm another person, he or she either:
a. Strikes, shoves, kicks, or otherwise touches a person or subjects him or her to physical contact.
b. Directs abusive or obscene language or makes an obscene gesture towards another person.
In most States you will have to actually strike someone (without causing any real injury) in order to get a harassment charge against them. So, if the officer is mean to you, that does not mean that he is harassing you.
Second, you have given no real details about your arrest, so I will just give you some ideas of what an attorney will look for when trying to get an aquital in a DUI case. #1) what was the reason the officer stopped you in the first place, and was it documented (if he says that he stopped you for running a stop sign, then he should have written a ticket to show that thats why he stopped you). #2) Once he stopped you, why did he get you out of the car? Did you smell of alcohol? Was your speech slurred? etc... #3)Once you were out of the car, did he conduct field sobriety tests and what results from those tests made him think that you were unable to drive? #4) Was their a Drager or Breathalizer test done and what were the results from that? In order for a DUI case to hold up in court, the officer will have to show every step he took and what led him to each step. If he can do that, then you do deserve the DUI charge. If he really just doesn't like you, then he will not be able to show those steps in court.

No not really because a complaint has been made and they're just investigating it. If you complained to them you'd want them to go round the house of the person to check if its true or not. They should just see that there's no evidence and it's a lie and leave it at that. I think the problem is with the neighbour, not the police. Tell the police that the neighbour is harassing YOU by wasting police time, then they might not take their complaints as seriously next time

First off DUI means Driving Under the Influence. It does not mean Driving Under the Influence of Alcohol. It covers not only alcohol, but both illegal and prescription drugs. So technically you were driving under the influence. Also, under the influence can be up to the officers discretion. You do not have to be at or above the legal blood alcohol limit to be arrested for DUI. If the officer feels you are a danger to yourself or others, then you can be arrested.

Heres an idea, stop driving when you take that medicine you idiot. Just 1 DUI is bad enough and you can still legaly drive??? You should be thankful you still have a license. You have already proven you are not responsibile enough to have a license, so stop driving after you have taken the medicine. I hate a drunk much less one that thinks he can risk my families life on the fact you think you can drive when drunk. I hope the local police follow you everyday and pull you over every mile.

I was cracking my knucles ready to talk about my area of expertise here, police violations.
BUT,
It doesn't sound good, friend. If you suspect they are picking on you, you need the results of your test, and to prove they indeed lied. Bring on the concern to those on the methadone clinic. Maybe they have resources based ontheir experience

one of the warnings on methadone is that it may impair your driving. So why are you driving? Did you not believe the little warning? You obviously failed field sobriety tests so good luck in jail.

You know you are in the wrong, you just feel the cops are after you more than anyone else. It isn't true but if they see you and remember you, it's their job to keep people off the road that are driving irratically so as not to endanger other people. Quit whining and stay off the road. Believe me police have more to do than just "PICK" on you.

so you were DUI at least once - the first time. and you must be impaired in some way to get stopped again - i say it is you sir who harass us with your driving - there are way too many traffic fatalities for me to side with you, if you are on a program i say don't drive, when i am sick and medicated i do not drive, you should not either, if not for your safety please do it for ours.

If you have had a DUI ever at all I think they should be watching you. People who drink and drive kill innocent people and you deserve to be watched liek a hawk to make sure you never do it again.

If you get a DUI you have to be given a series of tests to prove that youre impaired, they cant just jail you cause they dont like you, there is evidence there. Dont try and fool us please, you should be locked up so you dont hurt anyone and be thankful no one died at your hands.
