When the two of you file your return, your wife can file an 'Injured Spouse" form with it. Injured, in this case, means that she could be financially harmed. She is the injured spouse, and the form will allocate the income and refund between the two of you, and asks questions about who owes the debt. It's a fairly simple form.
When you have your return done, at least have it checked over by a professional. H&R Block will check it at no charge to ensure that you're getting every deduction and advantage possible. Also, be aware that filing seperately may not prevent them from taking her refund against your debt. Your Social Security Number and name still go on her tax return when you file seperately.

Yes, the only way that she may get a portion of the refund is to file an Injured Spouse Claim where she attempts to get the IRS to understand that this debt is not hers and was incurred prior to the marriage.

If you use the "married, filing joint" status have her fill out and include with the return a form 8379/Injured Spouse Alllocation; which will keep her portion of any refund safe from seizure. You may also want to consider doing your taxes as married, filing seperate, which will also keep her refund safe.

They will seize your taxes unless you file for what I think is called injured spouse or something like that. In other words, you new wife can keep her share with the proper documentation.

In my brother's experience they took all of his refund-even after his new marraige. You may try calling H&R block and ask them.
