I sold something on ebay for $180 and I got really sick and was unable to send the item. I was in the hospital. The buyer recieved no communication from me so he figured he had been scammed. I've since tried reasoning with him and explaining and I've offered to send the item. He doesn't want to hear it. He filed a claim with paypal and won, but there were no funds in the account. I feel for the guy because he is out this money, but due to my recent illness I have missed work and have mounting medical bills...I simply can not pay him back. He is threatening to contact my local police dept. He is calling my house. I dont know what to do.

I just wanted to further explain that I did offer to send him the item when I got home; he didn't want it, he only wanted his money back, which I will have to come up with. I was not trying to rip him off. I just wanted to send the item and be done with it, but I will just pay him back somehow. Thanks for all the info!!!

I think you should find a way to pay him back or send him the item. Its only fair. If he tries to get the police after you then you would have hospital receipts to show you were sick and stayed in the hospital. That should cover you. I feel for you, but with all of the scamming scum out there, as a buyer I can see how he feels. How does he know this is even true (I believe you, but he is probably very skeptical, and if I were out money I would be too)...but I do feel you need to do something to set this right.

For anyone who has said that you are not responsible for sending the item or refunding the money, they, as well as you, are absolutely wrong.
You are responsible for sending the item. I understand that you were in the hospital, but I'm sure you could have found a friend or relative to deliver the package. BTW, if you where in the hospital, WHY and HOW did you spend his or her money that they sent you??
You were not sick enough to NOT spend his or her money, then you shouldn't have been sick to the point of not sending the item.
I'm sorry if this sounds harsh, but imagine how you would feel is someone scammed you out of $180 bucks.
Besides, no one believes stories from eBay as it relates to not sending money or item. You here them all the time from NON-PAYING bidders and/or sellers. You may or may not have been sick, I don't know. But I can tell you that no one believes such stories because they are used all to often from people on eBay.
Just send the guy his money back. You shouldn't have spent it in the beginning. And to be honest, I really don't believe your story. If you were sick, then how did you find the time or energy to spend the money that he sent to you via PayPal.
Your story doesn't add up. You need to pay this guy his money NOW, or I to would contact the police if I was him. What you did was nothing less than STEALING BY DECEIT! For that you should be kicked off eBay.
GOD, what's wrong with you people?!?

This is more a civil matter than criminal.
But to be honest he may have needed that product for a certain time and no longer needs it. So understand him. I would ask a friend to put the product on Ebay and try to get the money and repay him. This man may not have alot of money just like you and 180.00 is alot of money . Try to make it right by him ASAP. You can negoiate hospital payments for a couple of months to repay this guy. But if he does take yo to court he will win. Then you will pay alot more than just 180.00 you will pay court fees, filing fees, etc. Ask him to give you no more than 2 months to repay send him money orders of 90.00.
He may be having just as hard of a time as you.

Fraud, with the USPS, the credit card company used to make the payment, Paypal, and even as an Internet crime. Ebay's security page tells you all
You should, at the least, start a re-payment plan to pay him back. Send him something, because if he takes it at a federal level, like he can, you're doomed. In the end, regardless of your excuse, you commited fraud

Pay the man. Your illness is moot. You took this man's money, and you gave him nothing in return. The reason does not matter -- at all.
You can definitely be sued, and you will lose. Probably by summary judgment, even.
As far as being arrested, maybe something like fraud. States definitely have an interest in good business practices.
Again, pay the man.

If/When the cops come, tell them that you offered to send the item. Explain the situation to the police, they will understand. But if he is calling you, do not take the harassment.

Yes U can..That's why I'm a buyer only he should of understood seeing U were in the hospital I was in the same situation & I let him send it reguardless of how long I had 2 wait.Good Luck

Well, if you can prove you were in the hospital and prove that have contacted him to try to send the item, then i would say that you shouldnt have anything to worry about. You have tried to correct the situation and he is just PO'd. alothough he probably does not believe you were in the Hospital.

Thats against the law..its kinda like going to a store and buying an item and before you leave they take it from you and you cant get it back...they can't do that so you can't do that either. I've seen it on court tv..lol =P

pay pal fronted him the money, so he has it now. pay pal will hound you for it and failer to pay them could result in bad marks on ur credit report, but no... you cant be arreeated, and wont be suid. if it was much, much more they could put a lein on your house or car or something, but for that were talking thousands of dollars.
