I bought a sofa on a credit agreement (which I have not yet started to pay) from a large company back in June. I was told it would take 14 weeks, but it still hasn't arrived. In the meantime, the store now has the same sofa in the sale at £300 cheaper! Can get my sofa at the cheaper price? They say no...

If you entered into a contract and they have not performed in the contract i.e. providing the sofa within the 14 weeks stated then they have breached the contract. Make a point of saying that this was a condition of the contract rather than just an estimate and it was important to you that you had the sofa within those dates. This way it will be found to be a term of the contract rather than just a preference. You have statutory rights under the Sale of Goods Act with regard to purchases. If you go to the store and tell them that they have breached the contract and say that you will take legal advice on the matter, and then see what they do! If they say they will not cancel the contract even though they have failed to perform you can go to a solicitor and get a letter written. This will not really cost much money most solicitors offer a free half hour interview under the legal aid system. If you do get a letter written it will probably only cost you around £50 but make sure you instruct your solicitor that you only want the letter writing and do not want them to take further actions and incur further costs. If they do try and come and deliver the sofa I would refuse delivery as soon as you have taken delivery you will have accepted the alterations to the contract. You could also threaten to report them to the Trading Standards Association.
You go and get them! It is right annoying that happened to me as well with another large company they promised before christmas eve delivery I think they promised 18th December and then after a long argument it came at 11pm on Christmas eve. They should not promise what they cannot delivery.

Sounds like too much time has passed to get that credit. If it had been a matter of weeks rather than months they might have been more willing to work with you. You might try threatening to return the sofa if they don't offer you the sale price. Furniture goes on sale all the time though, so they may be unwilling to offer you deals every time it goes on sale. Also, lots of places now charge a "restocking" fee of about 10% of the purchase price if you do opt to return the sofa.

Furniture stores are notorious for this, the mark up is usually over 100%.

What you have to do is just cancel the whole deal. Did the store also supply the credit agreement? becaue they get commissinon on those credit agreements too.

Just tell them you are no longer interested, and buy the sofa elsewhere. They have broken their agreement to supply it so you owe them nothing.

Absolutely. You can get an adjustment if you bring in the receipt. Or, what I do is I cancel the order or return the item and then re-buy it at the sale price. You can inform the store that you plan to do this and chances are they will give up and honor the sale price.

I don't think so. The credit agreement is probably on a contract that you probably signed. When it comes to things like this the price is always a fixed (permanent) price. So I guess you're out of luck, but don't worry. This happens all the time to other people. Hope I could help.

If it's not been delivered in the stated time, you can cancel the order. What you do after that is up to you. Check with your local CAB for advice on how you might proceed.
