Okay...a guys question a few mins ago reminded me of this....About a year ago, I was at a gas station at like 3 a.m. calling my mom on a payphone (i didn't have a home phone or cell). Anyway she works nights as a nurse and i have insomnia so i decided that i wanted to talk to her about something...i'm getting off of the point.....anyway, as i'm sitting there in my car (i pulled right up to the payphone (it was cold outside!)) and this cop pulls up and asks to see my drivers liscense...BTW i was at a 24 hour gas station...he gets my liscense and runs it and low-and-behold i have a warrant for a freaking bounced check that i had wrote a while back and was fighting the bank over (longER story). Anyways he procedes to cart my A$$ off to jail....can they do that??????...i wasn't breaking the law talking on the payphone....

I wish cops would find something useful to do. Like go after the crack heads and the prostitutes. But no they would rather issue traffice violations or pull people over for no reason.

It is legal, what you said, however unfair.

I posted that I have been pulled over many times and given no reason and everyone just said I was a bad driver. If I was a bad driver, why was I not given tickets or a reason for being pulled over all of those times. I have been repeatedly pulled over for no reason and even told that I should go home. I was 24 when that happened, does that make sense.

Yes they need to get a life and go where they are needed instead of looking for people on the roads who are most likely going to work or somewhere where they need to be on time. I have been late for many things because of cops being *ricks.

The cop needs to have probable cause to stop you in the first place, and if he did, he should have told you what his probable cause was. Using a payphone at 3 am is not probable cause either. If he gave you no reason for wanting to see your DL, then he was in the wrong. I would contact a lawyer if I were you, and consider sueing the officer and his department. Bad cops like that who have no regard for the rule of law, and the proper way of enforcing it, should be taken off the streets.

you probably could have refused to show him your id, and asked what the cause was. But once you had an outstanding warrant you where fair game. The same thing happened to my boyfriend. Well similar, he went to a store, left the car running and went in to grab cigarettes. A cop came out (who by the way left his car running) and waited for him to come out, then he asked to see his drivers license siting him for leaving the car on and unattended. BS. Then he ran his license and found an outstanding warrant for a traffic ticket for which he had been issued a warrant for.

Its crap. you gotta know how to resist legally. Like they don't have a right to ask for your license if your not driving.

If the officer had just cause to question you (late at night on pay phone can look suspicious, even if innocent) and then discovers you have a warrant, that is what they do! They have to take you in to face the warrant....it automatically gives them the right to arrest you and find what needs to be done to clear yourself. Sorry! That really was a bummer. I hope you get it resolved ok.

Yes! it is legal. The person inside the 24 hour station was most likely getting worried and called the police and then the cop I.D's you to check you out. The person in the 24 hour station was protecting their butt!

He could do that if he had probable cause. He may have thought you may be a drug dealer because of the situation with the phone. Unfortunate for you, when he checked up on you , you had a warrant. He had no choice but to arrest you. If you didn't have that warrant, he probably would have sent you on your way.When you were on the phone you were not breaking any laws but you have to admit it looked suspicious.

He had a warrant issued by a judge. Yes, you can be hauled to jail no matter what you were doing. Even if the case had been resolved, as long as there was an outstanding warrant he had to take you to jail.

possible that he was following you and scanned your license plates.
Since you have a warrant out, they could have been looking for you for awhile and he was able to bring you to jail.

now that you are out, i'm assuming you have a court date. Get a lawyer and get together all the documentation that shows you have been trying to resolve the issue with your bank.

Just because your weren't committing anything wrong at the time the police stopped you, this doesn't negate the fact that you have a warrent out for you. This was legal.
