We (Husband and I) pay a monthly tution rate for our 5 yrd old daugher. We live in Texas and for the last 3 years we have been claiming a deduction for daycare since we both work. Are there any deduction/benefits for paying for a private school?

Once your child leaves daycare there are no deductions or credits until she goes to college. Then there are 2 credits available to reduce your/her costs. But by the time she goes to college there may be changes in the tax codes of either your state or the Federal govt to allow some kind of tax credit for her attending a private school. The idea behind this is that the parents of a child that goes to private school are providing an open seat in the public schools to lessen overcrowding. The parents usually argue that they're paying 'twice' since their real estate taxes are still paying for a public seat their child doesn't use. Good Luck

Not at the federal level. If the school has daycare before and after the school day (some do), then the portion attributed to that might be able to be taken as daycare expense if they split it out, for example by charging a higher rate if you take advantage of the daycare time than for people who don't.

There could be some states that allow a deduction. Since Texas doesn't have a state income tax, that wouldn't apply to you.

I concur with Judy. Our office actually has a few clients who have day-care expenses at a private school. However, the education element through 12th Grade is not deductible.if you are going to take advantage of any after-school care that the schoo provides, I would recommend separate bills and separate checks in payment. You will need the same sort of statement at the end of the year that you should have received from daycare the past three years.
