No. Only if you have sex...and it is not illegal for the minor, only the adult.

An 18 yr and older can get in trouble for doing anything with someone under 16, if their parents push the issue to court. And some parents will do that if they do not approve of the relationship. It is ridiculous if the one person is 15 about to turn 16 and the other person just turned 18. But parents have done it before. If you are 18 and above, I would be hesitant to date a younger person. They are not mature any way.

Depending on the laws in your state, the person over 18 could be arrested if the minor's parents wanted to file charges for sexual misconduct with a minor. If convicted, it goes on the criminal record of the person over 18 and they become a registered sex offender.
I'm in Texas and know a young man who this happened to just 2 years ago. He was 17 when he started dating the girl who was 16. Her parents didn't like him and filed charges after the first time they went out after he turned 18.

The words" making out" are not defined well enough to answer this question If you mean "going all the way" then the answer is that the legal age may very from state to state. To get a proper answer the name of the state needs to be supplied.

It's more likely that the person over 18 would be charged. The consequences vary by state.
By the way, talk about your relationship issues with a responsible adult, not with strangers online. Don't engage in adult actions until you are able to be responsible yourself -- and it sounds like you're not there yet.

however it really depends on how many years older the 18 year old is older than you, there should not be a three diff between you two
