I mean that the person is caught while using it for commercial purposes.

If you are knowingly using it for commercial purposes, then you can do some jail time, but if you get caught using it for personal use, the worst that can happen would be, that it gets confiscated.

If it's an individual user using it the company will probably fire him and he'll be pressed with copy right infringment.

If it's an entire company then i think it would be a major lawsuit.
