Report the bastard to the Local council, and Police. and just forget about recovering your cash. oh and dont mention you suspect he is a Pakistani, he might be a Bungla, or an Afgan and take exception to being mistook for one of Imran Khans lot.

Why are you afraid of going to the police. If there are witnesses, go to the police and if the ice cream driver is fine and you daugher is not, I would consult a lawyer. He should have insurance and that should be against the law to drive without insurance. Do yourselves a favour and contact the police and a lawyer.

Maybe you could go to the police with her to offer moral support. This guy is selling mainly to kids, imagine if he hits a child next. Maybe the insurance company should also go to the police. Either way, get this man off the road or at least on it legally.

She needs to go to the police. And consult with a solicitor about recovering her excess. Her insurance company should be pursuing recovery from the at-fault party. If they do recover, she should get her excess back, and possibly her NCD if she lost that.

apart from the obvious vehicle insurance this trader needs, I bet if you follow this through it would be brought to light that he has no public liability insurance or is he a registered business.
You could be bringing someone who is working and claiming benefits not to mention not paying tax on his income under the hammer in a court of law,
Get him reported and seek legal advice for the proceedings you wish to take

It is your civic duty to report his offence (driving without insurance) to the police. You have all the reports already made to your daughter's insurance co. to back you up. Tell the cops you are concerned in case there are repercussions - hopefully they will be able to reassure you.
