Sherrifs are per legal tradition, Common Law, and what happened at our founding...but police, SWAT, FBI, US Marshall's, BATFE, ect? If you don't know, please research it and post the answer...it may be eye opening!

Cops are Constitutional under the so called reservation clause (10 Amendment): anything not expressed or prohibited by the Constitution is reserved to individual states. Police departments are therefore set up in state constitutions (state troopers) city charters (town cops).
just stay away from them, and you'll be cool

Yes police are constitutional. It is covered by the executive branch of our government. The idea was created as a way to help the sherrifs with law enforcement. In some states, the police are controlled by the commisioner while the deputies are controlled by the sherrif. This is to create a separation so that one person cannot corrupt the whole system. Although they are constitutional, I would definitely like to see their public relation skills be declared illegal as most of them do not have any and need to learn some.

Primary function of any Police officer is to ensure the publics Constitutional rights are not violated.

Thier second function is to enforce local and state stautes.

(I do realize that it seems that many officers forget thier primary function and only concentrate on the latter)

They are since they are not restricted by the constitution.

Example I can discriminate against red headed people, since they are not a protected class, but I can't on religion, race, sex and so on.

There is a difference between being legal or being given a specific duty.

This is an old question and has been answered many times by the courts. Yes they are constitutional and their powers are upheld. Do your research and you will be surprised.
