he got married behind my back in the military and very threatining to me

Most courts dont take a child away from its mother unless the mother is unfit to raise it. So I think your safe. Good luck.

No he cant unless he can prove you abused drugs or alcohol or put the baby in danger while pregnant. As long as you are a fit mom your ok. But, I am married to a man in the military and the absolute best thing you can do is write everything down that he does. Keep a log of every threat and report to police anything you can. the more documentation you have to take to his first shirt or commanding officer the easier it will be for you to get him to leave you alone.

Take it to the courts immediately. HE THREATENED YOU!!!!!!, FILE A REPORT WITH THE POLICE!!!!
Now it's on file, 1 point for you. So when it's court time, it's documented and WILL work in your favor.

Don't be a wuss about this either, he's a military man, he want to win, he's trained to win. Don't be someone that goes into a war without a weapon.Change your whole outlook.

Buuuut, take it easy, get some help because STRESS may harm the baby. Find someone to help carry with the weight.

He does not have to prove you unfit. Rights of the fathers are increasing every day. You need to get an attorney and file for custody first. Nothing is certain and you need to cover all bases. Good Luck.

I also want to add...if you do not have legal custody and he takes your child for visitation and decides to not give him back, there is nothing you can do about it. You will have to take him to court to get the child back. Do not let him visit under any circumstances until you have custody.

How would the new wife feel about taking in someone else's child?

He'd have to prove that you're unfit, sweetie. There are things you can do. I'd suggest talking to your local Department of Children and Families about your situation and if there's anything YOU can do to keep him from taking your baby.

Yep .. only if he can prove you unfit to have the child. Get an attorney .. and if he is threatning you .. get a restraining order once he gets back from the military if you want to stay alive and well. Good Luck ! :)

This is how it is in CA...it's different state to state. It is possible. If he is not unfit and you are not unfit...then you might have to share 50/50 custody with your ex. I assume that you are seeking full custody, but he could fight for it too. It sounds like the worse case senario is 50% and a court date. Good luck! Things like previous drug abuse and cheating can be used against him (and you too). Good luck with your situation!

No he cannot! You can control this! When you have the baby (if the dad is not there) don't put the dad's name on the birth certificate. Don't even do it to get child support (that's what some mothers do and they are sorry later). If he is already married, he cannot make you put his name on as the father.

Doubtful, as he cheated on you and is never home due to military service anyway, unless he can prove you unfit.

Somehow I doubt his new wife would be into raising the child of the woman he left for her....would you? Does she even know about you?

This is a very complicated situation we have no details about...impossible to answer...but the last person was right, probably only if you are unfit. Just be on your best behavior.
