I work for an insurance company - they should pay up as being caught drunk / refusing to give a breath test is not sufficient grounds for them not to deal (unless it is expressly mentioned in her policy booklet) If found guilty at Court, she is likely to recieve at least a 12 month driving ban, a fine of 200 pounds and about 6 points on her licence. She will strugle to get insured afterwards though...

Not a good move as I'm sure she realises now.
They will be quite hard on her, as they are getting very tough on drink-driving. There is so much publicity about it (as there should be) which has raised social consciousness to it's highest - people in general are really against it and that is also reflected in the punishment too.
She will be banned from driving for a period of time, I'm pretty sure.
Also insurance companies often have a clause that they will not pay out any claims if the driver is convicted of an offence that relates to the same claim... But she will need to read the small print - company rules may differ slightly.
I guess she won't be doing that again in a hurry!

I would of thought that your friend will more than likely get the following
1) 12 to 18 month Ban
2) heavy fine (reduce on appeal)
3) the insurance company won't pay up as driving under drink will invalid the policy, so your friend will have to pay the costs for repairs and anything else that comes with it.
4) I don't think she'll go to jail
If the above happens, she should count herself very lucky and should have learned a big lesson.
Oh and once she gets back on the road, insurance will rocket, if she can get some.

UK right, sounds like a 12 month ban.
Insurance will pay out but she will probably pay an increased insurance premium when she hits the road again, although I know someone with 3 drink drive convictions 2 x 36 month bans 1 X 12 month, who has no problem with high insurance.
I believe the ban should be both drinking and driving and anyone found drunk during the ban should be thrown in jail

She'll get a stiff sentence, possibly custodial plus a fine - she may also be ordered to retake her test.
Not only was she driving 'under the influence' but then refusing the take the breath test, just made things so much worse.
Some insurance companies wont pay out when drink is involved, she would have to check with her company.
She was a bloody fool and was lucky no-one was injured - she deserves everything the court throws at her.

If its her first offense, she will probably get a fine and points on her licence, she may lose her licence for a period of time.
Refusing to give a breath test was dumb. It points to guilt, therefore the police have no way of knowing how much over she was, therefore it will be up to the judge.
If she has been only just over the limit, the consequences would be obviously a lot less than if she was 5 times over, but as there is no way of knowing, the judge may well be able to sentance as he wishes, im not sure.
I hope she learned her lesson, that could have been a mother with kids she crashed into.
I hope she loses her licence, and has time to reflect on how stupid she has been.

The key word here is caught. She realizes that she did something very wrong or she would not expect the book that they will throw at her. I suppose she does deserve every bit of the consequences to her actions. This is a learning experience for her that will make a deep impression on her so continue to be her friend and help her along as much as you can. Let the experience be a teaching tool to you also.

Oh well.
Sorry but no sympathy what so ever. You should not drink and drive.
Not too sure about the court though but it will be a ban for a while and then very heavy insurance for the next few years.
And for the cars she hit, if her insurance doesn't pay up which I don't think it will the owners will be able to take legal action to fund for the repairs.

She will get a driving ban a big fine and her insurance may well refuse to pay up. She will not go to prison though. Failing to do a breath test carries the same penalty as failing one and is viewed as an admission of guilt.

No her insurance wont pay out she will get banned and have to resit her test again when the ban is up. i feel sorry for the other people who lose out their cars are damaged. I hope they ban her for years she deserves everything she gets good job im not the judge i would put her in prison she has no consideration for others. And could have taken a Human Life
