Did you call the insurance company when it happened?
If you have collision insurance, your car getting hit while it is parked is covered; it has happened to me. If you did not file a police repaort and contact the insurance agency, you screwed yourself out of any chance to get reimbursed by the insurance company.

Excess? Meaning the coverage on the motorcycle will not pay because it was stolen? If so, then file a claim for collision under your policy and sue the jailbird for the deductible. (hahahahahaha!) Sorry...couldn't help myself. The likelyhood of recovery is slim to zero even providing that the theif was captured. He/she will probably serve two years in county jail and will have no assets when released. Chalk it up to life lesson # 2008.

Your insurance company should be able to recover your excess from the motorcycle owner's insurance company. Their TP cover would pay for that.
For the other Yank posters, Excess is the British term for Deductible.

Hopefully your insurance will make some attempt to get back the money they put out and also your deductible from the person who caused your damage. If they don't you can always attempt to sue for the money you are out and get a judgment in your favor. Getting a judgment and collecting on it are two different things though. Good luck with it.

Yes you file a suit against the insurance of the motorcycle.
If the driver of the motorcycle is known you sue them also

It sounds like you're referring to your deductible. You can't get that back unless you are successful in suing the driver of the cycle. If you're not referring to your deductible, then I would say go with Cowboy Bill's answer.

If the biker was at fault you can take him to court or his estate. He should be carrying Liability Ins. in most states and if that is the law where you live have the law inforce it>
