My grandson's BIRTH mother is suing for his custodety, but I know she doesn't want it..., She's pretty sure she can get it! She's told my grandson repeatedly she doesn't want him... She's worn him down and is guilty of both physical and mental abuse (not so much as my son, who died this morning from a police shootout - see prev. question if u want details), and he was adopted at five years of age by my son who abused him, then I took custodety of him and he's been fine. How do I stop her from getting her hands on him? He is 17 - what should I do? She's also been an unfit mother to two other children (both boys, one sixteen and one fifteen) but she has a defenite "in" with the court, so to speak.

Whenever she goes to court to try to get him she will be looked at by a court mediator and the judge. Your grandson is old enough to tell the judge himself whom he would like to live with. The judge will take all considerations in his decisions. Just because she wants him doesn't mean she will get him. Get a good lawyer.

If the kid in question is 17 then put him on the stand in court. I don't know where you're from but I know here in my state a child at the age of thirteen can be interviewed and then make his/her own decision on which parent/guardian to live with.

In most states, even at 17 the boy should be able to make the decision for himself. The most you can hope for if it comes to legal blows in a courtoom, is have him testify about his mother's abuse and the security and stability he's experienced living with you.

I do not think you have too much to worry about, and at 17 years of age, he can speak up for him self. If you have had him all of this time, the ground work has been set. God Bless you for being their for him. He is not going to forget that!

Depending on the law in your state, the boy should be ok. In most states if he doesn't want to go, then he doesn't have to, he has a say in what happens to him. Ask a lawyer what the law in your state is. Doesn't she think it is a little late to try to be a mom now. Good luck.

get a good lawyer. if you do lose, he will be eighteen soon, and then he can choose his life path for himself. he will return to the one who treats him well and who loves him. he's almost an adult. it will work out. if she's been unfit, you have a good case.
