I don't know about Canada, but in the US child support and visitation are two very separate issues. Whether you see the child or not, you owe child support -- it is the part of your wages that would have went to helping raise your child if you were still with the mom. Visitation is something else, contact a lawyer and work to enforce your visitation rights.

umm dunno about the applause but i can only imagine the pain of ur situation. As long as there is no possibility of physical or emotional abuse then NO ONE has the right to deny access to ur child. It's just f**king cruel! I've seen it too many times: A couple split up n manage to hide behind the 'best interests' of the child but are actually punishing the other partner by using visitation like a carrot on a string. It's not just women who do that either! Be warned- the English legal system is pretty damn vicious on fathers who are not English citizens. A good friend of mine was stupid enuf to get a pommy nurse pregnant (in Australia) n she pissed off back home about 2 weeks after she told him about the baby. The baby is now 18 months old n he's still arguing for some kind of visitation. He's got a privately hired lawyer & an Aussie Defence Forces lawyer! Good luck.

I am a mother of two who receives support and I never have denied my ex husband access, although he accuses me of doing so! I totally sympathize with you. what can be done? If I were you, i would hire a Private Investigator to find out where your child is. This would be money well spent, then you could make an application in supreme court (which she couldn't obviously appear to if she isn't in the country) to have more access and ask for sole custody. The courts are likely to grant it and you can make the application yourself (see supreme court self help website"google it if you have to"). Too many parents (mothers and fathers) dont' put the children's interests first and that is appalling, they didn't ask to be born and they didn't ask for this strife. It is an adult problem and the adults should start taking care of that.

Because the second woman has as little moral or even worst moral than the deadbeat dad. She's in there just for the money or companionship. Or just because she wants a child so much, not caring whether there's enough resources to bring the child up. She just have her biological clock yelling at her saying she wants a child now, any child. That really says something about the second woman. The deadbeat dad never respect the second woman. I have heard that some even go on saying that they actually respect and love the first woman more. Making fun of the second woman.

They had this on the news the other day. I didn't watch it all since I'm not involved in this sort of thing but they were saying that in IL now there is a law enforcing visitation rights.
Where you married? If you were then check your divorce papers, what were the rights given to you? If she is breaking the divorce agreement then all the better to use to take her to court.

Here's a link of the Canadian offices who deal with visitation rights. In Canada it is considered abuse to deny a child visitation with the other parent as long as there isn't a reason (such as abuse and so on) that they have been ordered to stay away.

Good luck

Get another lawyer and keep bugging the courts until they tell you where they are. Legally she should not have been able to leave the country without your permission. If you think she went back to England contact a lawyer over there and have them do some PI work. Since you did not give her permission to move them you may be able to get custody. As for the privacy laws, they should not matter since they are your children and you should have access to them unless they feel you are a threat to them.

well you need to contact the courts of her location and put in an adjudication for visitation. dont let her run off with your kid they will find her if you pay child support. and as for moms getting support and not giving visits. i never recieved any support from my sons father and when he decides to be a dad which has been a total of 2 visits, 20 min each in almost 4 yrs i dont want his money nor his presence near my son. he has a dad in his life and no amount of money could buy my sons time from a real dead beat dad. good luck i hope you get to be a part of your kids life.

The whole system is totally f'd up. My ex hasn't paid his measly 100. a month in over a year(I thought I'd be nice and not go ahead with increases). Still trying to decide if it's worth it to fight for it. And, I haven't denied him his visitation. But, the child support isn't supposed to be "in lieu" of visitation rights. It's supposed to be for the support of the child. Good luck!

She is in the wrong and if you have visitation you and she won't let you see the baby/child then that is kidnapping. If you have a child with her then you should be able to get her address. I would contact a lawyer and get some legal advise on what to do and how to go about it. But it is wrong to take a child from a parent if they want to be involved.

you should have a right to see the child. i don't know what to do to help you, but you should do what you can to try and change this. Women are aloud to get abortions or put the baby up for adoption, but the father is forced to pay child support for a kid he can't see. Doesn't make any sense and it is wrong. I would try and make a big change! good luck!
