No ,it does seem wrong to me, but since he was 18 ,he no longer qualified for a long term in a Juvenile Facility. The Prisons are overcrowded and they let people out who are a menace to society, the father of your friend can bring a civil suit against this person and win a financial judgment against him. The incident must be documented with all available paperwork, the Police Report, Medical treatment. I hope his parents take the creep who did this to your friend to civil court, also it is important that they show up for the guys trial, he is probably out on bond. Good Luck and I hope your friend is doing better.

Why do people tend to phrase questions so as to elicit the answers they want?
You give no details, which makes me wonder if/what Tony might have done before he got punched. So, yeah, given your vague question I'll say "yes", there are times it's okay to punch a 12 year old. Or an 8 year old. Or a girl. Or whatever.
If Tony was coming at me with a knife, or threatening to harm someone else or maybe even himself, or anything where punching him to stop him would be a lot better than allowing to do whatever, then punching him is the better choice. If that isn't the case, however, if the guy just punched him simply because the guy was being a jerk, then that guy should be punished severely because what he did is so wrong.

It's not right for anyone to hit another in any situation unless a life is threatened. Now, with that being said. . .
Did your friend Anthony bring it on? Did he do something to piss off said 18 year old? Because maybe Anthony might be a little more cautious in the future.

No it's not right and the 18 year old better be glad I am not Tony's mom or else he'd find his butt kicked good and proper. I know teens hae a tendency to smart talk others but punching a minor is not a good idea ever.

The fact he got out does not mean he will not have to go back to a trial, or that he may not be arrested latter after an investigation.
Also anthonys parents need to be sure and press charges

The crime committed is physical injuries or unjust vexation under the Penal Law. File a case against the 18 year old so that he will not get away with the offense.

Maybe he only got out of jail because someone bailed him out. He may still have to go to court for a trial. If he spent time in jail it is self-evident that he was arrested by the police and they should be investigating it.

no..the dude should have got charged with "battery",and have to pay any doctor bills, and maybe even sued for pain an suffering..an 18 yr old has no business touchin a 12 yr old....it doesn't matter what caused the punch in the first place..i'd have his parents push it..or he might keep beatin up on little kids..what a punk!!!if it was my kid he did that too..i'd kick his a** myself.....then hold him down while my kid kicked his a**!!!

this does not sound right at all!!! the guy should be in jail. maybe anthony and his parents should press charges. if he had a concussion then you have proof enough to have this guy put where he belongs.
