No. But I would agreed that damages awarded to punish the corporation (not pain and suffering) should go into a fund.

If you or anyone had a great job for many years. Then some uncaring person caused you to work in a hostile environment. You quit or was fired. Sued, after months or even years the verdict/settlement or what ever was in your favor. What price would you put on the time and hardships this caused you and your family? Think of the domino effect. Until we treat each other with due regard and respect, those "better than the rest of us" boss types will continue to walk all over whom ever they want.
On the other hand, if the few among the rest keep filing frivolous claims and drive up settlement cost, the ones that suffer is all.
Protection is covered for Sex-Race-Age-and sexual infractions that cause undue hardships, and are unwanted and unwelcome.
Bosses support, and teach it, but some do not practice it.

So are you saying that if you do suffer from the actions of others - you can't be compensated ?
If so, tell me where you live & I'll come around & smack you in the head !
Here's the simple deal - whatever a person does - they ARE responsible for the consequences. Think before you act !
NOTE : this is NOT support for the AMOUNT of compensation, just the concept that a person is responsible for their own actions & must compensate others for the damage/pain/suffering they cause.

You ask thoughtful questions. The rational behind pain and suffering law suits is to make a statement, not to reward the plaintiff. The tobacco industry is an example. For many years they have been selling a product they know is unhealthful and addictive. It is well known that a tobacco product greatly reduced in tar and nicotine could have been marketed, but why lose market share. They were and are(Asian markets) selling a drug. It is addictive and it kills. We go after cocaine and heroine dealers, but those who sell cigarettes are free to go about their business. They bribe those in power. They are corrupt, but mainstream. It is all about hypocrisy.

I believe in the pain and suffering awards more than the actual damages simply because with these large corporations, the only thing they seem to understand is how something effects their bottom line. The point is punishment, and I believe it has its place.

there needs to be a very low cap on pain and suffering awards. 10k MAYBE. I'm all for compensating people for tangible losses they endure, but when you get to something so subjective as 'pain and suffering', it makes it very easy for an immoral lawyer to screw the system over and earn a lot of undeserved money for his clients.
