I recently married a foreign national (from Poland), they will ask you how he entered the country during the interview process.
My suggestion would be for both of you to return to Brazil, then get married there legally. You are then able to petition to have your spouse join you here in the US. There are several files available on the US Immigration website. Good Luck!

Hi,
The first question you shall ask him -- how he entered the USA (did he have a visa and was inspected on the border)? If yes, then you might be able to help him to obtain a green card.
Of course, he does not need to apply for a visa (because he is already in the USA). What he and you need to do is to apply for his adjustment of status to that of a lawful permanent resident (=green card).

when you marry him, he becomes legal. It will be hard to prove that your marriage was not fictitious, because he is already illegal. He will have a driver license, will be permitted to work...
I hope that you love him, because if you are doing this just to give him a legal status, you might be fined very much money, about $500 000 because you may not marry like this.

Pay an attorney. You are about to step in a huge pile of crap if you don't. Make sure it is a good immigration attorney.
Your alternative is for both of you to move to Brazil. I hear it's a great place. Air fares are cheap. Go on now, up, up and away!

you can either apply for their finance or spousal visa. I suggest you get an immigration lawyer here in the US to help you fill out the paperwork.
