I Wouldnt Describe It As A "Right"
We Have The OBLIGATION To The Security Of Our Citizens
Secure Borders And Ports Are High Priority
The USA Has A DUTY To Protect Her Citizens
See :
The US Constitution
Article 4
Section. 4.

We are not circumventing any ones rights. Its our land and our border to secure. If we were trying to keep Americans in this country ,instead of illegal aliens out then there may be a question.Illegal aliens do not have civil rights in this country. They are by definition "illegal".
We as a nation have every Right to secure our borders in what ever way we want. And we are doing just that.Get that fence built ASAPIt is as JD said our obligation to our citizens to secure our borders.

Treaty of Guadeloupe Hildago (just a snippet)
"Other provisions stipulated the Texas border at the Rio Grande (Articles VIII and IX), U.S. promise to police its side of the border (Article XI), and compulsory arbitration of future disputes between the two countries (Article XXI)."
I would say it's not even a "civil right" I would say it is OUR Duty!

I wonder why u use the terms civil and right. I would say that the USA has full soveriegnty and everything thats involved in that. To keep soveriegn...one needs to delineate who is in and who is not.
