Going by the books of law ( I can't help as I did gradulation in law also) both would be punished provided none of them is below certain age (and the age depends on the law of land - say 7 year for india)

Stupid question.
If you made a mistake you should be punished for it.
Trying to blame someone else just won't get you off the hook.
You're responsible for your own actions no one "made" you do it.
Where's the explaination?

Both should be punished. With equal severity. The one who put the idea in his head should be punished for instigating or hatching the conspiracy as they say. The one who actually did it should be punished for the crime. Both are equally griveous crimes before the law.

both are to blame because in love there is a commitment...
U can not expect the other person to do all the hard work all the time to keep the relationship going...
If the one doesn't get what they want for the relationship then they are bound to find happiness elsewhere....
so i think both are to blame...

no one must be punished punitive behavior, and blame are not mandatory, they impede finding resolution to the conflict, instead ask what can I do to help or prevent this from happening again
