Okay, I am puzzled as to why illegal immigrants can get those food stamps and live off the state.. is it because they can have naturally born citizen babies?

If this is true, I think it's wrong!! If an unmarried parent or both parents are illegal, then the country shouldn't grant the baby citizenship.

I said ILLEGAL aliens. Legal ones, I have no problem with those.

And to the girl who said that unless I'm a native, I think the current American citizens living now, in these days, is big factor to the success of the country, so native and across the ocean explorers, we built this country so I say, we all have the right.

They are allowed to be citizens automatically if born on USA soil. It is a misinterpretation of the Constitution, which many people want clarified and enforced. It should allow that baby to be a citizen if AT LEAST ONE parent is a legal citizen.The legal citizen parent can stay here with the child, the other one gets deported. Otherwise, they should all be deported.

Unfortunately, they do receive citizenship. But there is a catch- the parent can't file paperwork for the minor on her or anyone else's behalf to move to the US. The minor can't even file paperwork until they reach the age of 21. This law was put into effect so that some illegal who gives birth after jumping the fence can't move here due to their child's citizenship.
The ones who file for food stamps and live off the state are sometimes here legally........through marriage or work, surprisingly. They then either quit or leave their spouse once they get their green card. The illegal ones in some states aren't asked their citizenship, and the ones who do ask aren't able to notice real and fake documents.

Unfortunately the answer is yes.

These are called "anchor babies". Not only do the babies have automatic citizenship, it also gives the mother a legal reason to stay in the country. Further, the taxpayer is expected to foot the bill for the delivery of the child as our emergency rooms can't legally turn anyone in need of immediate medical attention away and both of them are then eligible for food stamps, wick, and a variety of other social programs. To add insult to injury, if you live in an area like I do where the illegal immigrant population has produced tones of these "anchor babies" you have a bunch of school aged kids who are legal US citizens that do not speak even the most basic of English. As a result many elementary schools have become "ESL" (English as a second language) schools where Spanish is spoken more predominantly than English, thus putting the English speaking kids who's parent's (grandparents, and great-grandparents) have paid the taxes to fund the school at a disadvantage.

I truly don't think that people from non-border states have a handle on the scope of the problem.

Lower courts treat the child as a citizen and the child may be, under the 14th Amendment. However, in determining that the child of legal foreign residents was a citizen, the Supreme Court specifically withheld a decision as to whether the parents, if illegally here, would be sufficiently 'under jurisdiction of our laws' to have a citizen baby. Children of diplomats are not citizens if born here, because they are not 'under jurisdiction of our laws.'

Barring a Supreme Court decision that they are not citizens, they are considered so, though.

I think if they do away with 'family reconciliation' that lets citizens 'automatically' apply to bring in parents, some of the incentive for 'gaming' our laws would be missing and at least the damage would be lessened. I think that would be an easier short term fix than amending the Constitution.

There is nothing in the Constituation mentioning the citizenship of a child born to parenta of illegal aliens. The reality is, LEGALLY, they are NOT HERE!!! They have no say, and they have no rights! So! if a child is born to one of these NONPERSONS, the child can not be recognized as a citizen of this country! He should take the Nationality of his father! This is a gray area where illegals take advantage of our system, and USE the child as a tool to remain in this country. I say, unfortunately for the child, send the WHOLE family back to where they came from!! NOW! if these people escape being detected for years, which happens all the time, and the child reaches the age of 18, THEN! he can request to register as a Legal alien, IF he can prove he never went back to his fathers country, and wants to stay here and has never been convicted of a crime, and wait the five years like the legal aliens have to, and only then would I give him citizenship!.

Yes.. sorry the law states if you were born here you are automactically a US citizen... now the parents don't become citizens.. and you can't always have dual citizenship so say two people from Mexico have a baby here and the parents get deported when that child turns 18 they would have to choose one or the other.... This is just an example.. I don't know if you can have dual citizenship with Mexico and the US or not.

Yup, sure can, they actually have duel citizenship and have to decide when they are 18. Its n not just "illegals" my best friend is from Holland and her son has duel citizenship. BUT... when her husband went to prison for being a PERVERT.. she divorced him and was not eligible for any assistance granted she has a pretty good job).. but we were both pissed that the illegals get hand outs right and left while she has had to pay big $$ for all her documents and stuff. Not to mention the poor Down Syndrome baby the immigrants litterally just LEFT at the hospital when they moved on to work in a different field. Good ole uncle sam gets to pick up the tab on him for years. Plus.. why doesn't my friend get to choose DUTCH when she goes to the ATM? Why doesn't laundry soap and stuff come with dutch instructions too? If your in the states, make an effort learn the language. I had to when I lived overseas.

I agree. Just because they happen to be here when they give birth shouldn't be an automatic pass for anyone. I suppose we paid for the delivery too. Oi! I've got no problem with those who come here legally and become citizens and then have a kid and that kid gets full citizenship rights- but this illegal thing has to be stopped in all its forms!!!

Girl, you said it yourself we all have the right. Remember your history part of the United States use to be part of Mexico until all these other immigrants came in claiming land, causing wars. So they do have a right to what use to be their ancestors. Just as the Native Americans have claimed what was once theirs. And YES the baby is a citizen if born here. Sorry to disappoint you.

Yes, any person born in the US or in its territories have the rights to citizenship. Also it makes it easier for the family to live here. Also, any person born overseas to military or foreign diplomats still have citizenship to the US, but i think depending on the country they can apply for duel citizenship. Its not pretty, but the first people to form this country can trace their heritage to another country, so cant really do away with this law.


Travis: NC has one of the highest influx of illegal immigrants, we feel it just as much as you... they leave the boarders and move to states that are growing. NC, SC, VA, Tenn. all feel the pain... Believe me I know!

It is my understanding that they call these babies, anchor babies. This means that if they are born in another country, they have dual citizenship. This is not unheard of in other countries. This would mean that they have dual or multiple citizenship. My cousin had a real good one. Her father was from Norway, her mother from America but she was born in Africa. My uncle is a diplomat from Norway to whichever country they send him to. That is where they were when my aunt delivered her!

When she was 18 she was to choose what country she would belong to. She picked Norway because that is where they usually live.

So simply put, yes, I do believe the babies get citizenship. It is not right in my book. You should be the citizen of your parents country they are currently citizens to when you are born.
