Be it a ministry (in the Commonwealth) or a service (in the USA), it derives from the power of the head of government, either a prime minister or US president.

The excutive powers are used to execute laws. The President or PM appoints the functionaries who administer such laws. In the US, some such executive offices are subject to confirmation by the Senate. In the UK and elsewhere, there is clearly a necessity that the minister enjoy the confidence of the PM and by extension, his or her party.
