I was at the toll plaza and it was bumper to bumper traffic. I took my eyes away from what was immediately in front of me (someone almost hit me to the side!) and i tapped someone's 89 Volvo. I tapped it pretty hard but certainly did no damage. And there's is no possibility of bodily injury. After talking to him for a few moments it became evident that he is going to pursue this- he is just the type. He's going to try and milk it and exploit the situation. How much can he get? How much will my rates go up?
BTW- he had used a lane you are not supposed to use as a passing lane and had cut in front of me a couple minutes earlier. He has a cracked tail light but it was from a previous accident. I am sure he will try to pin it on me. We have the same insurance companies.

Leave it to your insurance company to decide. He'll get what he gets; there's not much you can do about that. You rear-ended him and are clearly at fault.

If the damage to his car is obviously old, you won't be held responsible. But do keep in mind that not all damage is immediately apparent to the untrained eye. It doesn't take much to bend a bumper mount and you won't know without crawling under the car and inspecting the damage.

What he did earlier is not a factor in your accident. I'd keep that to myself, though. If you mention that to the insurance company, they may figure that your hitting him was retaliatory for his cutting you off earlier -- very bad karma there!

BI will be up to the doctors to decide. It doesn't take much to get whiplash. Since you're not a qualified physician (and even if you are, you haven't examined the other party!) keep that to yourself as well.

you don't say that you called the police, you should have, because they would have made note of the damage if any
now it's just your word against his and since you hit him in the rear, he'll win

I would hope that if you explain to the insurance company as you've phrased it hear that common sense would prevail.
