OK here's the problem my mamaw and papaw are married-he has lived with a girlfriend for 26 yrs who claims she is married to him. Now mamaw is sick and girlfriend is trying to split up their properties already via papaw. How can I find out if he is married to both? We searched the court house and can't find anything. We need help what can we do to find out if he's indeed married to both and where mamaw's rights stand? She's too sick to fight for herself and has searched and searched to find any grounds that papaw was indeed married to both women without results.

Legally a person cannot be married to two people at once. The previous marriage would have to have ended in divorce with legal documentation of divorce.

The courthouse in the county in which they were married would have to have copies of their marriage license(s) as well as recorded copies of the actual certificate of marriage which is turned in by the judge or preacher and recorded after the marriage has taken place.

It would seem to me the burden of proof would have to fall on the girlfriend who claims to be married to your papaw. Ask her for a copy of her marriage certificate. This would be readily available to her at the courthouse. If she can't come up with it tell her to take a hike.

I would be curious to hear what your papaw has to say about all of this. Is he just standing idly by and letting her do this?

I think the best thing you could possibly do is get an attorney. He will be able to research all of that information for you.

Well how about the civil registry of the National Statistics Office...If you Mamaw was married to your Papaw first and they havent divorced then, she doesnt have any right and their marriage is null and void.

First of all, you or your mom don't have to prove anything. if your dad's girlfriend says they married then she is the one who will have to prove it. don't let her browbeat you guys into anything. the way i understand it, no one has any doubts as to the marital status of your parents. if your dad married his girlfriend without divorcing your mum, that's illegal and your dad and his girlfriend will be in trouble. she cannot split up any properties herself. you will have to check with a lawyer though, to see if your dad can legally give her any of the properties.
your research and work should be focused towards determining what rights your mum has to any of the properties and how to counter the other woman's efforts of gaining any of them. there are many different tracks to take depending on the marital status and inheritance status of the 3 people involved here so you should definitely consult a lawyer on this. if the girlfriend says she married him, let her furnish the proof, why are you doing her dirty work?

Southern S is correct. Unless he is divorced from your Mother you have nothing to prove. His relationship with his girlfriend is only that. A relationship. Unless your Father can prsent the documents they are not divorced.

maybe the girlfriend just claims to be married.
i would imagine it is different in different states. i would have to say you need a lawyer.
