Is this in the koran? Or is just a social thing? I was under the impression that all Sharia Law was gathered from the koran.

Incase a woman is raped she needs to produce 4 male witnesses to rape which is extremely rare as such things rarely happen in public and for the icing on the cake, the woman is either stoned to death or beheaded for adultry incase she is not able to produce 4 male witnesses. This is Islam in practice.

Well, there is no Islamic state as of yet, so no one really implements Shariah correctly.

No, the rapist must recieve punishment. Whats under debate is what should be done with the victim. I, as well as many Muslims, personally believe that the rape victim should not be punished as is done in many backward countries. What such "islamic lands" do is not islamic -- its their own backwardness.

There is actually little direct information about rape victims in Shariah law -- which is why scholars must develop something based on Shariah itself. For now the obvious answer is to help the victim and punish the rapist.

Its hard to find anything about rape in traditional sources. It seems rapes were uncommon at the time of the Prophet Muhammad pbuh (tells you a little about the state of our society huh?).

The be conscious "rapist" has replaced meaning in the 3500 years because of the fact the previous testomony replaced into written. at that element, an sexual relationship between 2 single human beings replaced into seen a rape, regardless of if it replaced into non-violent and consensual between adults. Even right this moment we've rules that make a non-violent, consensual sexual act between an grownup and a minor a "rape". yet comprehend that it is different from a violent rape. Human nature has no longer replaced in 3500 years. Even decrease back then people who have been in love could have intercourse in the previous they have been married. under the regulation, that replaced into seen an act of rape. although the regulation found out that often the intercourse replaced into non-violent and consensual. in case you study the verse in context, it is conversing of a "rape" wherein the female replaced right into a prepared important different, no longer calling for help or revealing the act. It replaced into consensual. If got here across, the family contributors (father) had the choice to make certain directly to permit the couple to marry, somewhat than to value them with "rape". Even right this moment, many states will drop "rape" expenses regarding an grownup and a "almost grownup" minor, in the event that they marry. This regulation replaced into no distinctive. God knew that persons in love have been going to have intercourse now and returned in the previous they have been assume to. So he allowed them an "out" by using allowing them to make the region actual after the info by using marrying.

Recently in India a woman was raped by her Father in law. The local maulavis ordered the girl to leave her husband because he would be her son now !!

When the woman appealed to the highest sharia board, they slapped a small fine on father in law and ordered woman not to live with her hubby..as it was against Islam

Finally she went to police and took shelter under the criminal codes of India

I donno if this was really Islamic..or idiocy of local muslims

that's not true. this verse talks about relation between the man and women.

[231] ...... But do not take them back to hurt them, and whoever does that, then he has wronged himself. And treat not the Verses (Laws) of Allâh as a jest, but remember Allâh's Favors on you (i.e. Islâm), and that which He has sent down to you of the Book (i.e. the Qur'ân) and Al-Hikmah (the Prophet's Sunnah - legal ways - Islâmic jurisprudence.) whereby He instructs you. And fear Allâh, and know that Allâh is All-Aware of everything.
Quran 2:231

i didn't know that they did that, but a lot of those nations view women as property and cattle and so if they were raped they must have been doing something that provoked the rapist. i bet it goes somewhat along those lines.
pretty sick moral code in general, don't you think?
