depends on why you are suing them

if you are suing them because they violated your rights under a federal statute, then you can sue them in federal court. Otherwise you sue them in state court. County court does not have authority to hear those cases where the state of CA is named as a defendant.

If you cannot afford to sue, you can file "in forma pauperis" and have your fees waived in federal. State may have something similar
