why do killers not get the death penalty automatically? The reason they don't get death automatically after conviction is because the justice system allows the defense to appeal the conviction, and they take the case to appellate court to see if there improper procedures done in collection of evidence or improper compiling of facts. In addition, some killers IQs are pretty low near Mental Retardation and that also taken into account when giving a death sentence since they did not understand the crime they committed. Their the drunk at the bar situation a person gets into a car and kills the other driver. Death penalty is banned in a couple states, and most states the death penalty only applies to premeditated murder or killing of children under the age of 12. The jury should make the say for death sentence not the pros cuter. Also, if society sent every person convicted of manslaughter and murder we be asking eye for a eye and that is wrong. Only 5% of cases in Untied States get death because the other 95% of cases other factors were taken into account like mental stability, mental capability to understand the crime committed, and past behavoiurs are factored in.

If the Prosecutor chooses to go after the death penalty, the trial is done in two parts. The first jury only decides guilt or innocence, the second only decides the appropriate punishment.
This is done in an attempt to be fair to the accused. The accused can be expected to spend the first trial claiming "I didn't do it", but in the second to claim "Okay, I did it, BUT...." so he gets a lesser penalty.
It's not automatic so that the accused doesn't have to do both at once.
I didn't make that theory, don't even necessarily think it makes sense, but that's why.

Let me add a couple of more to your list, child molesters and rapists. I am for the death penalty 100%. I'm tired of these people spending a few years in jail and being let back out in society to rape, kill, and molest again. But the death penalty doesn't always mean death. There are inmates that have been on death row for YEARS and will probably just end up dieing a natural death. But that's ok, as long as their still locked up they won't be committing crimes against innocent people.

I think it depends on the circumstances and gravity of the deed. Many have been found guilty only to have the verdict overturned. Wouldn't it be awful to carry out the death penalty only to find out the next day that the person was innocent.

Because many have been convicted and later proved innocent. Often the system is rushing to get a case resolved for reasons other than justice.
This applies to all levels of crime, like the Duke "rape" case where one of the people they decided to nail for the "crime" wasn't even there.
Many many more examples. There have even been people who confessed to crimes that it was later determined they did not do.
Just not a simple black and white issue except to the mentally incompetent.

Because of the law. A "killer" could be someone who drove drunk, or who accidentally shot someone hunting, or who punched someone in a bar fight.
The death penalty has stringent requirements.

most states have banished the death penalty....they feel this is an inhuman act, but I think they have forgotten the victim..no one wants to die and i feel if a person kills they should be killed...but that's my opion...

You have to be proven guilty first and then you have to see what kind of level of murder 1,2 or 3 and then it all goes from there.
