You can only apply for residence through a us citizen, not a permanent residence if you came legally. If you have been out of status for more than six months, you will need to leave and apply outside the country and apply for a waiver to get back in. I don't suggest that because if they don't approve the waiver, you are outside the country for at least 3 years if not 10 before you can come back. My advice is to get married (if it is for love), then have her apply for citizenship if she is eligible and once she gets it, then you can apply for your residence. You should not wait until she is a citizen to marry because the more time you are married when you apply for your residence, the better.

You entered the states legally. But you'r an immigrant or a citizen!! Married to a US. citizen, you have to apply, but at one point you have to leave the Country!!

its probably best you wait for her to become a US citizen... but if that will take a while, get married now... you will probably have to leave but not for too long. This things are best answered by an immigration lawyer.
