It depends on the jurisdiction, each dept has their own policies, as a general rule most depts discourage it because of the fact that predators often pretend to be cops to get their victims to pull over. A single young woman should NEVER pull over for an unmarked car, if he's a real cop he'll get a marked patrol car to make the stop.....as to your question, yea, it is legal, a good lawyer can take care of it easy enough.

If he's not in a police car he'll call someone he know's and tail you and get the license plate until the other cop shows up to take care of the rest. But if he is still in his police car he can still give you a ticket on or off duty it doesn't matter.

You mean it's an off-duty officer that gives someone a traffic ticket. He can do it. Many departments, depending on size and rigidity of department policy, may discourage it. But as to whether the officer can do it or not, he can. He has law enforcement powers 24/7.

Depends on the ticket? the police on the job 24 hours day, and if local police departments getting bitched at from city hall to raise funds. The police cars start pulling over for stupid violations to increase revenue like tail light broken, and speed traps set up where it doesn't count on driving record its more a money maker ticket, and it depends on the location the police are in. If city hall de-links revenue for ticket the police-car does pull over for more apporaite violations like excessive speed, excessive noise things that disturb the public safety. Finally, a wealthy community cops more looking for real violations instead of piss ones. The police officer just doing his or her job pulling you over for things 90% of the time, and you run a stop sign you deserve the carnival lights approaching in your rear-view mirror.

Just because they are off duty doesnt mean they wont stop you. You hear about off duty cops doing things all the time.
A cop is a cop, and if you were breaking the law then you got what you got.
