Yesterday, my husband who had our three year old, got busted at a popular merchandise store. He's been booked and has a court date of the 26th. I've been begging him to stop for months and it's finally caught him. What can they do to him on a first offense?

what did your 3 year old have to do with it? did the 3 year old do anything? that would be a theft charge. he needs to be in court.

It all depends on several factors, such as the cost of what was being stolen, etc. Quite often, a first offense will result in probation and community service.

Since it sounds like your husband has a problem, he should also recieve counseling. You might be able to cut a deal with the judge to have it expunged (permanently removed from his criminal record) if he attends counseling during this period.

I was busted when I was 17 for some shoplifting, which made me an adult. Here, since it was under 1,000 dollars, it was not a felony. I had to attend a class on theft and write a 2000 word paper on what I learned, then my charges were dropped and all my records expunged. Though it may be different since your husband is not a teenager. And at the time, I had a lawyer, but my parents paid for him, so you may have to carry that burden.:)

He will first get a warning, and then go to jail. He does have right see below{quotes cops says when you get arested" :

You have the right to remain silent and refuse to answer questions. Do you understand?
2. Anything you do say may be used against you in a court of law. Do you understand?
3. You have the right to consult an attorney before speaking to the police and to have an attorney present during questioning now or in the future. Do you understand?
4. If you cannot afford an attorney, one will be appointed for you before any questioning if you wish. Do you understand?
5. If you decide to answer questions now without an attorney present you will still have the right to stop answering at any time until you talk to an attorney. Do you understand?
6. Knowing and understanding your rights as I have explained them to you, are you willing to answer my questions without an attorney present?

I don't think you should worry about your loser husband. It's your three year old that has been exposed to this behavior. Take care of the kid. The "Dad" Will just have to pay a fine. But the kid needs to get away from this guy.

Spend 10 times as much as he stole on lawyers fees, then pay the fine, then possibly jail time if they think he encouraged the minor to particpate.
