My daughter (18) got a job at a car lot, the owner sexually harrassed her on several occasions. After rebuffing him, he told her she was fired. He pays "under the table" and she has no way to prove she worked therer. He paid her $40.00 for 2 weeks worth of work, and now refuses to pay anything else...What recourse do we have?

Add: She filled out tax papers, the office manager never filed them. She didn't know she was working "under the table" until 2 weeks later (payday) and there are several people who owrk there, all young pretty girls....All saw her and know she worked there. We (parents) also went there on a few occasions to see her and drop stuff off to her.

Ask her to write down the hours that she worked, and try to find somebody that she worked with to verify the info. An employer doesn't have to withhold income tax, but she is supposed to pay tax on her earnings anyway. If you can come up with a dollar amount for the hours that she worked, send him a bill. (make copies, send it registered so somebody has to sign for it) If he still doesn't pay, then call the city or county employment commission, because he is still responsible for paying various taxes that relate to having employees.
If he did this to her, he's probably doing it to others, so ask around.
Another way to have proof that she worked there would be email correspondence to or from the business, any kind of schedule that was printed. Did he pay her $40.00 with a check?
As far as the sexual harassment, get a lawyer if it was serious. Lots of lawyers will give you a free consultation, so check around to find one in your city.

Well getting the proof that she worked there shouldn't be too hard. Other employees and even customers should be able to prove they saw her working there. Of course many won't want to get involved in it. If the car lot is a dealership then you can report him to corporate head quarters. But if the lot is privately owned that changes everything. I'd just make a call to a lawyer who would be willing to answer a few questions for you over the phone. (some will) Or call your local police dept. and see what they suggest. This guy is a creep and shouldn't get away with it. I wish you luck.

1) An employment agreement
2) Training materials
3) Co-workers

I'm not sure that you have to "prove" employment before you prove sexual harrassment. First, contact the company's human resources department. If they do not have one, contact a local attorney and/or legal services. They should either be able to help you or give you a referral to an attorney who can.

As your daughter was ILLEGALLY working under the table, thus avoiding paying taxes(owners problem also) maybe its best to let it go and use this as a moral lesson. But...if you must, then I am sure others worked illegally also-report him to the I.R.S. They will most likely audit him later on-more headache than any other method. Good luck.

So there were no other employees that worked there. Video tape of her working there. Go to the authorities anyway. Don't let that creep get away with it. I t illegal to pay under the table so at least have him investigated.

none. you cannot enter a courtroom when you are doing something illegal to begin with. They have a word for it but i forgot it. Anyway chalk it up to a lesson well learned and the next time make sure your daughter works for a reputable company and pays taxes like everyone else.

Report him to the State about his hiring practices. You have little evidence to support a sexual harassment case, but if this is his usual way of employing people he will get in enough trouble when caught to balance out the scales of justice.

Unfortunately, it seems you don't have much to go one here. Live and learn as the saying goes, but in the future (hopefully something like this doesn't happen again) she needs to keep proper documantation: dates, times, locations, what was said/done, witnesses, if and who the incident was reported to again with dates and times.

Everyone supported Clinton when he sexually harrassed and groped many women.
