There was one US state that used to have an age of consent as low as 14, and now to my knowledge, all of them are at least 16. See source below.
The reason why age of consent matters is *technically*, someone who is over the age of consent should *NOT* be having sex with someone who is a minor. While "18" is thrown around by a lot of people, it largely depends on your courts. Courts love to enforce the law on people messing with minors. The thing is though,as the age of majority varies between 16 and 18, your particular state may not enforce the law on a 16 year old.
Saying all of that, its illegal in your state. New Jersey's age of majority is 16. If the other person was 16 or maybe even 14, they may be more likely to look the other way, but at 13, I'm pretty sure that most judges would find it wrong. You gotta realize that sometimes law is supported by morality, and from a morale standpoint, its quite wrong.
Note though, I'm not an American and I'm not a judge, so you'd have to look into it more to find out for sure. One of my old classmates (not a very good friend but I just recognized the name when I saw the news) was charged with it though and during that period, I spent a bunch of time looking into the issue out of curiosity.

In New Jersey it isn't illegal as long as there is no sex involved.
But in New Jersey the law mandates the legal age of consent is 16 male 16 female. So legally she has to be 16 to have sex with a 16 yr old or older guy.

The only age for consent that is legal is 17 in most states. Anything under that is illegal as hell. For someone as young as her and the boy being his age, he can be tried as an adult for sexual misconduct with a minor even if the minor is turning 14 soom.
Anyway, your friend shouldnt be letting or doing anything like that with boys until she is much older and of consenting age. There is no legal youthfull curiosity in any state. She needs to get away from this boy who is getting her to do these things.
Even at her age, its not consent but a form of rape. Be it psycological or physical and is punishable by law. Her parents need to know whats going on too so that she can be protected in the best ways possible if its not too late already.
Tell her that HIV is a killer and knows no age limit or class distinction and is transmitted sexually. Even if there is no intercourse she can still get it if this boy is a carrier and has had sex with a carrier or used tainted drug needles. Not too mention all the other STDs that you can get. Even from just kissing somone infected with one.
She needs to calm down and wait till she is quite a bit older to find out what sex is like and make sure that its with someone special and not someone that just wants sex from her like this boy seems to be leading up to.

I'm not sure. I think Jersey has a scale uder which its progressively more illegal to do things to younger people. You have to go to the library and check the statutes.
Generally, however, most state courts are reluctant to convict minors of statutory raping each other even if they fit within the perview of the statute. That is because, in interpreting a statute, courts should not achieve a result that would be absurd, perverse, or contrary to legislative intent. Many state courts have held that it would be perverse to convict minors under the very statutes meant to protect them.

It's perfectly legal until he turns 18. Once he's 18 if she is 3 years younger than him then it's illegal. Atleast that's what it is in Texas. My girlfriend just turned 17 and I am 18, but I think it's illegal for an adult to date a minor anyways no matter what so yeah.

State Laws vary, and in some states he could get charged for Statutory Rape, regardless if he's under 18. But the more important issue here is that she's having an all-out relationship with an older boy, and could get into bigger trouble if neither one is educated enough about responsible sexual. Let her try dealing with a life altering situation like explaining an unexpected pregnancy to her parents.....or dealing with an STD at that age.

The legal age is 16 (i think), but the girl should find someone her own age she's playing with fire and most definitely will get burnt,
There are so many under age pregnancies and S T D out there it's not safe

I believe CA law says if both under 16, then Legal. I don't know about Right, though. Sorry to be cynical, but hello, he's a 16 year old! That's all he wants to do at his age.

It really depends, i think in some states, if your a 16 yr old messes around with someone under 14, its illegal, and for an 18 to mess around with anyone under 16. it really depends on your states. check in to your state laws and look up the laws.
