As I was working out in the gym, I happen to find a cell in the treadmill. I took the cell. I decided I would call the "Home" contact on the cell to see if they can come pick it up, or if they wanted me to go drop it off, after my workout. As I was about to call the home number, the cell rings and it is the owner. I tell the owner " I have found your cell where can I met you to give it back?" He says met him at the the gym. I go back to the gym where I give the owner the cell phone, he then tells me to come closer, and shows me a badge, which I could barely see, and asks my age. I say 17 and he threatens to take me to Juvie. He then procedes to say "If it were the wrong person you could've been F'd up, get lose chump". I go away.
I did not do anything wrong, I was nice enough to return the phone. I felt mistreated. He goes to the same gym and I plan on asking him for his bagde # the next time I see. My ? is if I ask must he give it? And what can I do about this situation.

I don't get this--what is he busting you for? Do you think this might just be some jerk--whether a cop or not? Maybe there is more to the story.
But to answer your question --an undercover officer does not have to give you his badge number or show you his badge or tell you he is cop. Think about it--that would not work too well doing undercover work.
But, in your case. If this guy did treat you this way. And there is no more to the story than what you related--I think you should report it to the police department and file a report. They will be able to determine who it is from the description you have given. If he is a cop he acted inappropriately. If he is not a cop he is guilty of impersonmating a police officer.

No if they are undercover they do not. But this guy sounds like he maybe off-duty if he really is a cop. Sounds more like he is impersonating a police officer. Make a police report with your parents, see if management at the gym can get his name, have your parents demand that the real PD conduct a followup investigation. If he is not a cop then he is committing a crime. If he is a cop he should be disciplined by the department for bad conduct.

No, a undercover police officer will never show you his badge, he will deny being a police officer.
Next he would not merley show a badge, the badge would be in a case along with a ID card. If he was a off duty officer.
so no a off duty police officer does not have to show you his badge and a undercover will never even admit being a officer.
A uniform officer or a officer on duty in plains clothes will always show you a badge on official business

yes all law enforcement officers must present the badge and ID when asked, sounds like this guy was a security guard trying to act bad . Besides, he couldn't charge you with anything if you found the phone. He should be charged with stupidity.

An undsercover cop will not identify himself as a cop. It would blow his cover. Assuming the badge was real (and I'm not conviced), he was off duty, not undercover. If he is showing his badge, he is required to give his badge #. He is also required the have his deparment issued photo ID and show it as well.

just out of curiosity did this person actually claim to be a cop or just flash a badge and threaten you? if he didn't claim to be a cop i would think just flashing a badge is not in anyway against the law-- unless he is trying to use the badge to receive something or take you into custody (so to speak) just a thought

you'd have to check the local laws, but generally speaking...yes they can. Police must identify themselves (generally) and provide identification if requested. They also have to have "probable cause". Your porch is outside, so is considered to be a public area and doesn't require a search warrant. If there are people drinking, and some people look under 21, then they've met "probable cause".

The question should be 'Does an off duty officer have to show / produce his badge when asked' or 'Does an off duty officer have to give his badge number when asked'??
An undercover officer absolutely DOES NOT have to show you anything....but an off duty or on duty officer must surrender his badge number when asked.

I would just drop this matter and forget about it. This guy may NOT be a police officer, just someone impersonating an officer. Just chalk this one up to experience, and next time if you find something, turn it in at they gym.
