Discover card said as long as merchant has imprint of card they can charge you for several nights and discover card cannot do anything about it, even though you have a signed receipt for only one night. Discover card said my only option is to sue the hotel. If this is true no credit cards are safe to use. Can this really be true??

Absolutely not. The burden of proof is on the hotel. If they do not have your signature on a document that list the price being charge then they have no recourse. I'm really suprised someone at Discover would tell you that. I'd call them back and tell them you're disputing the charges. If the 6 hours happened to fall in between the check-in/check-out time at the hotel and/or you signed papers stating you owe the 2 day amount, you're out of luck.

When you registered, was it a minimum two night stay required? If that is the case then you don't have a case. If it isn't, then it is illegal for the hotel to charge you and you should dispute the bill w/discover, maybe with a supervisor b/c that person gave you wrong information. It is illegal (unless reason above) to charge for 2 nights when you only stayed 1 (they probably counted the 6 hours as 1). Call the consumer frauds dept if you aren't happy with any of the answers (excluding the 2 night minimum stay).

I work in the banking industry and it is true that once you give a merchant your card that is considered giving them authorization to charge your account. However, under federal law you have the option to dispute the charges on your account and discover should have informed you of that. There are affidavits out there for every credit card that you can sign for them to go back, dispute charges to your account, andprovide provisionary credit in the meantime. I say definitely give the microtel a call and inform them that the charges are on your account, unfortunately they also have 30 days to correct the mistake. Be very detailed and document every conversation with them. If that doesn't work call Discover back and tell them that you have "unauthorized charges" on your account and take it from there.

I don't really know what's going on with this motel- but you might want to make sure your identity hasn't been stolen. If it has, I'm willing to bet that it happened there.
