Hi,

I had H1B visa. Then I changed to different company (outside US). so my present employer said they can't transfer my H1 visa because I moved to my present company from outside US.
I aplied for B1 visa and got the visa.
Is there any way to check my H1 visa validity status?
Is it possible to have both H1 abd B1 visa same time?

Thanks
VJ

It is possible to hold both a B1 and an H1B, but you can't work and get paid in the US on a B1 visa. The H1B is specific to the company that petitioned for you - you can't transfer it to another employer. If you no longer work for the company whose name is on your visa, the visa is no longer valid and you do not have any H1B status now.

An H1B can be valid for a maximum validity of 3 years. It usually depends on your employer for how long it is valid. It is valid for as many years as they sponsor you for. I didn't know it's different for Iranians, I thought if anything they always get only single entry visa, so they would need to get a new visa stamped into their passport whenever they leave before reentry. But if the original petition is longer I thought that they can get it up to 3 years like everybody else. If they don't leave during that time they would be fine. Which would be recommended because the security clearances can take quite a long time for them. I expect that Saint Kitts and Nevis don't have any particular restrictions whether they can single or multiple entry visa.

You can transfer an H1-B visa however it doesn't look like you can in this particular instance.

The law is complicated if you have gaps in the time line as you seem to have, consult a specialist immigration lawyer, you can find them on the net.
