he would have to return to his country of origin and apply for a u.s. visa. if granted he could return to the u.s. and then apply for a change is visa status to a immigrant visa from a non-immigrant visa and hopefully gets approved. you can also apply for a fiancee visa. you will have 90 day's to get married from the time he enters the u.s. if he is caught and deported that will interfere with him getting a visa.

If your friend is here illegal he can not get a legal green card. He has to get a family member that is here legally to sponsor him. Even if he married a legal US citizen, its still wouldn't help him. Even if he has an immidiate family member to sponsor him once the process for legal immigration starts he goes through a very intensive process of background checks, name checks, etc. If he is found to be here illegally for any length of time he could be deported an barred from ever coming to the US.
Sorry, I know this isn't what you wanted to hear.

You can't. There's no amnesty program in place at this time.

Even if he got married to a US Citizen he'd have to leave the country and re-enter via the proper I-130 spousal immigration procedure. If it was known he'd been in the US illegally previously then he would be under a 10 year ban from any type of legal re-entry.

Solution: Find fiancee in US, go home to Mexico (I'm assuming), have finance visit, pretend you just met there or online and have info to back it up, photos, &c., she goes home and files for I-129 fiancee visa application, or get married in Mexico and she goes home and files for I-130 spousal visa, then wait.

It took me from time of first meeting in January 2001 to her arrival in US in February 2002 and cost several hundred dollars in fees, a medical exam, photos, multiple forms, dozens of visits for her to various agencies including a trip to the capital city, and extensive proof of income from me, to insure my wife wasn't going to become a burden to the state.

And two years after that of interviews in the US, more forms, more fees, waiting for mail, and driving all over.

The girl would have to be dedicated to say the least, so no sham marriage there.

Here is the link to the USCIS Office of Citizenship. Some pages are also in Spanish:
http://www.uscis.gov/graphics/citizenship/index.htm
At this time he has only couple of options: marriage to US citizen or legal permanent resident, work or student visa.
Good luck!

There are a few ways you can get legal citizenship if you are illegal.

you can marry a citzen or someone else that has greencard.

you can apply for political asslyum.

you can work for a company that can apply for you.

there are other options but they might not be legal but you can always pay someone to marry you on paper and i guess after two years you can obtain citizenship.

my advice would be to obtaina good degree from a accredited computer school in programming or IT work and look for a job that will sponsor you this process akes time but will most likey over some time get you a good income potential and legal citizenship.

If he is illegal... have him return to his country and begin his paperwork there. Why reward a law breaker with the right to be here.. when there are so many that are WAITING their turn to come here legally?

Do you let people cut in line in front you at the market or theater?

I don't know if this will help, but the INS is now the USCIS. You could look them up on the web and maybe find something helpful.
