My parked car was hit by a minor. Her parents told me that they will not fix my car unless I go to a specific place of their choice. I told them it is not their decision b/c their daughter is the one who hit me. Her mother tryed to take over the conversation and I stood my ground and told her that this is their responsibility. She turned around and told her husband I was abrasive toward her(which I wasn't, I was stern), and he told me not to call the house anymore and he will call me if the estimate is satisfactory to him. I haven't heard back from these people and I am afraid if I call they will press charges against me for harassment. I am not trying to argue w/ anyone I just want my car fixed! Do I call the police and let them take care of it?

A police report was filed. I just didn't want to involve the insuarance co. and have my premiums go up b/c of someone elses stupidity.

If she hit your car, her insurance will go up, not yours. Also, if the damage is under $500 (or whatever your deductable is), the insurance company may not even have to get involved unless someone files a claim for the repairs (which you should do since you were parked).

Also, because your car was parked, you should not be listed on the accident report as a driver.

Insurance companies have a list of authorized body shops that you can use. You have the final say as to where you want the car fixed, not the other party.

I take about 50 accident reports a month. You are not unique in that someone who is at fault trys to pawn everything off on you.

You knew you were right and stood your ground. Good job.

Contact an attorney and take em to court....document everything !!! If you indeed have a report from the police showing your car was hit while it was parked, you'll have a slam dunk case in court. Sounds like the offender's parents will attempt to make it hard on you, but don't back down !! They are probably doing that to frustrate you so you'll drop the whole thing and fix it yourself. Civil court (small claims - depending on the amount) is where you'll have to go.

If the accident was caused by the girl, which it appears it was, it is chargeable to her and, probably, her parents, not you. THIS is why they didn't want the insurance company or the cops involved. Their premiums will go up - not yours. Only "chargeable" accidents are cause to raise your premiums. I'd be sure to tell the cops what these folks have been putting you through. They will do what they can to make it your fault, and the "squeaky wheel gets the grease." Protect yourself. And don't deal with them directly again. Work through your insurance agent and the cops. They COULD file harassment charges against you just to make your life miserable.

Your best bet is to involve the insurance company. The police aren't going to do much of anything for you. Your next option would be small claims court and you might get a judgement but that doesn't make the people pay it. Insurance companies deal with each other and its all done with no hassle.

The police cannot do anything for you. You have a civil case. Take them to the magistrates office AFTER you get an estimate on the repairs.

take them to court if It was her fault your insurance would NOT go up, because it would be her insurance paying for it. As long as you have that police report you should be good to go. They will probably screw you out if money and you have every right to go to which ever mechanic you want to, don't go to theirs it is not their decision, I think you should take them to court, and do not call them ever again, they can wait to be served.

you are late, but the accident should be reported to the police and your insurance company immediately, and take you out of the picture. let them handle it
