I pulled into a handicapped zone to drop off my brother when a parking cop comes up behind me and blocks me from getting out. I was there for about 5 seconds max...and about to back out when she blocked me in. Can she do that? If I'm in the car how can I get a ticket?????

Sorry, but yes, they can do that. One reason cops do that is because--I know you say you were only there for a "few seconds", but do you realize how many people pull into handicap spots for just a "few seconds" all day, every day? It adds up. Just avoid the handicap spots in the future.

The bottom line is you broke the law, no matter what the reason you can't park in a handicapped space for any amount of time without the proper documentation. the parking officer can give you a ticket, and can park where they need to. If it involves blocking you, it doesn't change the fact that you still parked in the space. Honestly it isn't worth fighting the ticket, because in court it will be proven through what sounds like both your testimony and the officers, that you did commit the offense. Pay the ticket, take traffic school if you can, but it probably useless fighting it in court. THe fact that the officer parked behind you will have no bearing, the fact is the offense was committed.

I fight all tickets because it would end up costing me at most $330, which is worth the time to go fight it.

If she was a police officer, she can detain you briefly to issue you the ticket. If she is not a police officer, she most likely does not have a right to detain you, in which case you could sue her for false imprisonment and tresspass to chattels because she prevented you from egressing through a manner of your choosing and she prevented you from full enjoyment of your property (driving it). It all depends if there is a state statute which gives a privledge to the authority. In my state, a private corporation issues tickets. Woe to that corporation should they ever attempt to block my vehicle in.

But fight it, you have to pay court costs anyway. Check the sign to see if it says no stopping, standing or parking. You can always claim public necessity to prevent risk of danger to the pedestrian from traffic or that you were trying to turn around. What about, you didn't see the sign until you pulled in and by then it was too late, you were imprisoned.

How psycho was this cop following you around until you pulled into the spot? Did the cop even check to see if you had a mirror hanger?

there should be an address on the ticket if not a box for you to plead not guilty/contest the thing.

Handicap parking is for people who are handicapped. My grandfather used to need those spaces, therefore, I give you no sympathy and say just pay up. Chalk it up to a lesson learned. I am sure I don't even need to go into detail about why they have those spots and why people who are perfectly capable shouldn't take them and use them for their own selfish use. Shame on you for parking there even for seconds.

Sorry, this ticket will stick. Show up in court only to get the points reduced if possible. Come well-dressed, professional, and apologetic. You'll still have to pay the price, but hopefully your insurance won't kill you too.
