Last night my daughter was caught at a park drinking with boys. Everyone ran and they caught the three girls that were there[[my daughter an two friends]] What is the penalty. She blew a .096 on the breathalyzer, and says she had two beers that she can remember. I don't drink myself, but does that sound right ? two beers and a .096??
What is going to happen to her?

That BA level is more consist ant with 4 or five beers. For example... it would take a 200 pound person 6 beers drank in 1 hour to reach a BAC of .1. He would then have to drink one beer an hour to maintain that level.
Having been a police officer for more than 20 years I never stopped anyone had didn't tell me that they "had only;y 2 beers.
As for the penalty, that varies by jurisdiction. It could range from a fine to community service. As long as she is not caught again she will not have any long lasting record.

1st with boys in the park ( Grand kids soon) .09 is more than 2 beers I have always heard "Officer I only had 2 beers" Not true she has told you a lie. 2nd get a lawyer. 3rd make her give up who the boys was that had the beer that will look good to the DA & the judge giving up the boys she could get off with little or no money paid and about 10-100 hours of community service.

She had more than 2, for some reason every drunk I ever arrested only had 2 beers. Big question is why is she in a park getting drunk with boys? She'll probably just get a couple of hundred dollars in fines and probation. But, you better have a nice long chat, drinking in parks with boys will soon give you grandkids you didn't want at this point.

She will most likely get what is known in Iowa as a "PAULA"...
Possession of alcohol under the legal age... It's like a 100$ ticket and with no priors, nothing else. If she ran from the cops, they might find another ticket or two, but if she gives up the boys who got away, she might get nothing. It's more important for the cops to find the boys providing the alcohol, than it is to crack down on the girl.

bac this reading more consistent with about 5 beers in couple of hours chugging it fine, or community work .096 is up there so don't get fooled by the little white lies of 2 beers go after whom gave the beer to her /them <<< former trooper

i don't drink underage yet i think of the government could desire to alter something the two the ingesting age or the age to bypass into the army because of the fact how come an 18 year previous youngster can bypass into the army yet cant have a undergo after he in simple terms watched somebody get shot? So i think of i could replace the age to 21 to be waiting to bypass into the army.

i think that her friends got her in to this and now that she has started drinking its going to be very hard to stop that becuse once people start drinking ,somking or other things its going to take alot of time to stop them.my dad does tabacco and he wont even stop doing that even if u take away his tabacco he still wont stop.when she live the house wait 20 or 30 sec and then go after her but be careful dont let her see u and when she is about to do it catch her and take her home and explain to her that when she is married her life is in danger and
she dont want her children to do the same that she is doing and put them in danger so its for ur own helth.another thing drinking,smoking wont take u to anything except death and so will be ur childern

But as she only 90lbs, its quite possible that could be her BAC (Blood Alcohol Content Level) as far as fines, that really depends on your city/county court judge...
But she will have to do community service and/or do a social service rehab program.
Which she will probably learn a lot of the dangers of what happens to teens when they drink, and learn about alcohol poisioning.
You're lucky it could of been worse, she could of passed out from alcohol consumption or posioning, and been slip the date rape drug, that happens to a lot of teens girls.

The BAC can be dependant on a number of things, including body weight and metabolism. I would recommend getting a lawyer...and how about you teach your daughter about morality and the law

NO i don't think she should be penalized ..she is underage
I think it should be the parents who should pay a big fine
I mean big £1000 or £ 2000 each time their underage child commits a offense .and after the third offense ..one or both of the parents should end up in jail..
YOU being the mother of the child should be shame of your self .you got a little brat who is out on her own ..drinking .Alcohol ..and ,she is a bloody liar at the same time.as you admit..what type of discipline are you using on her ..looks like none to me ...
I tell you what is going to happen to her ,she will get a telling off by the police ..they call it caution..i call it bullshitt..and she will get over it and go on to bigger things
if you don't take charge of her ..
