That's up to you. No doubt the insurance would settle. If you want money go for it. But if you want to get rid of the scar try rubbing vitamin E oil into it 3 times a day. Massage it over the entire area with pressure that will break up the scar tissue. Also apply sun block to the scar if you are exposing it to sun, because the sun will cause increased scarring.
Honestly, I'd give the vitamin E a couple of months, keep the site covered. If there is no improvement then call a lawyer, but be aware that your settlement may not be as much as you think, especially in these times.
No matter what else, take care of yourself.
On that point, you may have to prove that you took appropriate care of the site of the mole removal and protected it from sun, followed directions to the T

If you got everything they said signed on paper, then yes you can file a lawsuit....not for the scar, but for the stitches they forgot to take out. You can file under Medical Malpractice, and possibly Pain and Suffering...

medical malpractice is veryyyyyyyyy hard to prove beyond reasonable doubt because they would defend that the procedure they applied is the best for the patient, it may look to you that they forgot to take off few stitches but for them, there must be some scientific reasons why they opt to leave it for some time, maybe the wound is still fresh that it still needs support of the stitches, etc.
however if you have a solid evidence then you can go for it, hire a very competent lawyer who can help you around

well, if you were in a lot of pain, I think you can sue for pain and suffering. Malpractice lawyer is what you'll need. You should first consider how much you can get and try to settle out of court first. See how much they are willing to pay. You might get more money that way as lawyers are very expensive....sorry this happened to you...good luck... ;)

That same thing happened to me, but mine where on my belly (two of them) one right above the other, and the doctor who did it pasted away, so I said f u c k it, I got a man who didn't care, but if you feel like you could win then go for it.
