Your question is confused on several levels.

1. A four year old can not form criminal intent.

2. You can not sue someone AND have them arrested for the same incident. If they are arrested and found not guilty, you MIGHT be able to sue at that point, but not simultaneously.

3. Your course of action should be directed at the parents of said four year old. They are responsible for everything he does or fails to do until he reaches the age of consent (which would be December 29, 2019 in most states).

No you can't sue the kid, but I would for sure sue his parents!! Where the hell where they anyway, he's 5, its not his fault...its the parents fault...I have a 6 year old, he'd never think to do something like that ever...he's taught right from wrong and I keep an eye on him. Christ on top of sueing the neglectful parents I'd make sure the kid gets some counseling too...

if he turned 5 on december 30th, you could have him arrested... However, federal codes prohibit the arrest of a 5 year old born around christmas. You can sue him, watch out though, he may retain a lawyer. 5 year olds get special lawyer rates

You can make his parents pay. You don't have to sue, just let your insurance know who's done it and they will collect.
Also, you can actually have a record started with your 5 year old through the police dept. for your nephew IF HE"S A LITTLE DEMON CHILD ALL THE TIME.
If he's just made a mistake, then of course you should just get your insurance to collect for your damage, and then let him be.

No, of course not. Maybe his parents should offer to fix your car. Did you ask them? If you must sue, it would be the parents.

you can sue his parents, but there will be questions as to who was suppose to be watching him, how did he get the bat and how it got to the area where your car was at.

He destroyed your property and you can sue him for repairs.
