You have the better chance, but be careful he might try to dig up something to make you look bad and deem you unfit. Walk the straight line right now. Do you think he would really go that far anyway, that would cost a bit more than baby wipes and a bag of diapers. And take considerably more time than 24 hours. You will probably be granted custody and get child support but make sure to go through the courts they will come closer to making him pay and keeping track of him than you could. Ask the judge how he will split his little time between two children if he cant find time for even one? In a way he is only the sperm donor, and apparently a multi-distributing sperm doner. It's ashame the other girl is probably going to have the same situation and who know how many more will fall victim...

I'm 99.9% sure you would because he has only bought diaper and a pair of wipes. Plus the judge would also look at the new "baby".
You should ask for child support and full custody and he might want visitation your attorney should tell you about it before you file for custody of the baby and he might want a DNA test to prove the baby is his. I use to have a job a attorney's Secretary during the summer. I would answer questions like this over the phone or in the office. You could go to your local legal aide they have good attorneys in the field of custody if you can't afford one.
Good luck to you.

First of all, he'd have to prove paternity to the court to initiate anything. If you're going to go to court for child support, be prepared for a paternity test.
Unless he's got a lawyer, the means to support and a good reason to have partial physical custody, there's no way a judge is going to grant a father of a 2 month old full physical custody. IF it gets to court, he'll likely get joint legal custody if paternity is established.
Legal custody means he's entitled to information about medical conditions/decisions, education issues, stuff like that.
He may get visitation, but its all a time consuming process which costs $$$$ if you need lawyers. Mother's seeking child support have the DA working in the child's interest.
I wouldn't be too worried unless you're messing up as a responsible parent.

"loves them"? Are you not telling us everything? Generally speaking, custody tends to go to the mother. But depending on circumstances, this may not be the case. If he can make the case that the child is in an unsafe/unhealthy environment, and that he would be a better alternative, it may go his way. I have a hunch that he is seeking full custody because he is worried about child support payments. Play it straight and narrow. Dont do anything that will jeopardize your rights to your young one. It wouldnt hurt to find a part time job as well.
Is their a reason that you are both seeking "full custody"? Why do either of you have a problem with the other being part of your childs life? It kinda sounds to me like you two might be proceeding with these actions aout of spite, which would be unfair to the child, if that was the case. Be a good parent, and dont let selfishness get in the way.

Neither of you have jobs? How come? How old are you both? Where do you live? How do you pay rent? Why did you have a baby with a guy who won't step up to the plate and be a father? All or most of these questions could very well be asked by a judge. Its hard to say who a judge would grant custody to, its hard to choose between two people who won't step it up. Don't get me wrong, I think staying home with your child is awesome, but you have to be able to financially afford it.

inspite of the regulation and strong ideals supposedly featuring toddler custody as a point enjoying container, the mummy wins custody the super vast majority of the time. it quite is in simple terms the way it quite is. extremely with infants. greater possibly to work out joint custody than a father getting sole custody, and the courts are very very reluctant to furnish joint custody except the father and mom have a reasonably reliable working relationship. As for "understanding" the only available choose, i would not place too lots on that. Been there myself and understand many others who've additionally had the excitement of being positioned to the exterior. do no longer basically like the device. in any respect.

The court will look into both of your finacial, personal, and criminal(if you have it) past as well as looking into your current situations. The court will also take into account the amount of time spent with the child and current residency of that child. If Paternity is a question then a test will be conducted to gain a result. Now, a good lawyer is although something to have on your side along with witnesses to his visitation and your mothering capabilities. I am sure from what you have stated that you will win custody of the baby. But take into consideration all that I have said!

The mother does fair better in court system. I doubt your boy-friend will not put up a big fight if that is how he provides and spends time with your child. As long as you can provide a stable environment for you and the baby. The judge might enforce visitations. Don't worry I have been through this two times.

Normally the mother has full custody if you are not married. Did you list him on the birth certificate? That would also make a difference.

Make sure you do tell the judge everything you just told us, and it is more likely you will win custody and have the judge order him to pay child support.
