I just got back to the mall with my mom. While we were their my brother's car, he has my mom's, got broken into. The question my dad has does it go on our insurance or his?
My opinion is: his, because we were not driving at the time and it was just sitting in a parking lot and it was his car that got broken into.

The insurance on your brother's car covers it. Tell your dad insurance follows vehicles, not people. Your brother needs to carry comprehensive coverage in order for this to be covered. Also, please note- a lot of things won't be covered. Theft of personal items are not covered (for example, clothing, cd's sunglasses). If a permanently installed radio or other equipment were stolen they should be covered. Items damaged when the car was broken into like windows, locks, etc. will be covered as they are part of the vehicle.

Insurance follows the car, not the person who's care it is in. The claim would be filed with the insurance company who is actually insuring your brothers car. It would be considered a comprehensive claim and he would be reimbursed for any damages done to his car less the policy comprehensive deductible. Comprehensive claims are non-surchargable, and shouldn't raise your insurance premiums.

depending on the extent of damage that was done to the veh when it was broken into like any windows broken, or any items taken that were attached to the auto would need to be filed under your brothers auto policy.Any items that were taken out of the car that were considered personal such as cd's, wallet or any items not attached to the veh would need to be filed under a homeowners policy.

If your Mother had wrecked the car, her liability insurance would have paid.
But a breakin is different.
Whoever owns the car is responsible. Their 'comprehensive' insurance would pay, after the deductible.
In some case's, a homeowners policy would cover personal properrty stolen.

It would be your brothers, due to the fact there was no driver, so it would fall under the owners policy, in this case your brother.
