You really should see a lawyer. You can find one who is sympatheic towards animals by checking on spca web sites.

They were negligent is breaking in to the wrong house, AND they killed your dog who was only defending his master and his property. The dog was just doing his job. The police screwed up.

In the 1980's they caught the police in my town using stray and lost animals for target practice. Don't think it doesn't happen. There are some real sick cops out there.

I have participated in several search warrants and I feel that it is very unusual for a law enforcement officer to enter the wrong property. Despite this it is unfortunate that a dog was killed, a police officer has the right to defend himself against an attack. In New Zealand we use pepper spray or discharge a fire extinguisher which usually does the trick. We also have a section of law that states that no officer shall be held liable for shooting a dog for example unless it is proven that the officer acted without reasonable cause. Those who have seen a dog tear apart someone's arm would understand why this action was taken.

Lets see if I understand, they break in and think they are being attacked by the dog. I would think at this point they still believe they are in the right house. So it's understandable they would have to do something about the dog.
I doubt they said lets break into the wrong house and practice on an innocent animal, that's a stupid comment.
Now why the wrong house? I agree that it's their mistake and I suspect the cop feels bad but if someone sent him to the incorrect place I would find it hard to fault the cop but rather the system. I assume they have to pay for damage + the dog. Screw ups happen, not that that makes them right.

That's too bad. If it was your dog, I'm sorry that you lost the dog.

But the dog WAS pointing a gun... in a way. Dogs are armed to the teeth... literally.

I would certainly hate it, if my husband or my son was a police officer and was mauled to death by a vicious dog in the line of duty.

He made an honest mistake... breaking into the wrong house... but any dog that attacks without warning like that is a dangerous animal. Barking a warning would be at least reasonable, but attacking a police officer isn't something I would want my dog to do.

The dog doesn't have to be pointing a gun at him in order to be perceived as a threat. It's too bad the officer got into the wrong house though. It doesn't sound like he did it on purpose and the dog was doing the natural thing dogs do. He probably should make some sort of restitution for the animal, I think.

It is unfortunate that the dog was killed but he was doing it to protect himself from what he thought was an attack. Hindsight is always 20/20. Police officers face threats everyday and they have families that they love dearly and they are just trying to do a very hard job. It is called protecting the public and there is not an officer that I know that would not sacrifice their life for a citizen. It is a shame that these heroes have to endure this type of attitude from someone that they may have to give their life for in the future. And no we don't practice on innocent animals as many of us are pet owners too.

Any time a police officer "feels" threatened, they may and lawfully, take appropriate action to defend themselves.
If it was a case of wrong house, the only recourse for the owner is to file a complaint and maybe attempt to file a suit.
If the only action by the police was the animal being killed, then the owner may only receive compensation for the animal.(maybe)

If a dog 'lunges at' the officer, it is their DUTY to stop the dog. You said 'its not like the dog was pointing a gun'. OK, how about a knife? Claws and teeth are functionally equivalent to knives. As far as a claim for damages, the homeowner can seek reimbursement for the broken door and the dog. As long as the officer had reason to believe they were entering the correct house, they did notion wrong.

Sometime police officers do go into the wrong home. It could be due to misinformation, lies from someone, just plain confusion. But are they going to stop to ask if they're in the wrong house when a dog is lunging at them? Would you?

this is one thing that is wrong with our system, a cop comes to your door and kicks it in, what is wrong with knocking on the door and let the occupants hold the dog or put it in another room,
how many times have you read in the paper where the cops kicked in the wrong door and killed some one who had been asleep and was woke up by the splintering of their door?
will you or I be the next victim? or maybe one of your kids?one case in Calif, a cop shot and killed a 6 year old kid who had a cap gun and was coming down the hall way in a threading manner??
the officer who stated the cops would protect the public with their lives? hummm there were over 100 cops and another 100 firemen within 100 ft, of the truck driver in Los Angles when he was being beaten, no one would go to his rescue, civilians rescued him, after he sued the cops , The courts said cops are not obligated to risk their lives or safety for the public?? public servants?? tell me how faithful, brave dedicated they are?
the cop had no real right to kick the door down, had he been any thing other than a bully he would have knocked first, he could have killed a kid,or some one else, or have we given the cops the right to run rough shod over the very people who are paying his exorbitant salary for a cushy Job, no work very little danger,
