A Florida woman who lost her husband in Iraq may now be deported back to her country of Venezuela. Dahianna’s husband worked in Iraq, providing communications equipment to our military and was killed in March.
Immigration said, she and their 1-year-old son, must return to her home country, even though her son was born here in the United States. She doesn't want to go back because all the family she has is here.
She said she wants to stay in the country her husband helped defend.
From what I read, she has to be married for 2 full years, and she was 3 months short when he was killed. She lost her husband, why do they have to take everything else away? What do you think about it?

Her husband was a contractor, but it says he provided communications to the military. I know that SOME contractors go there for quick money, but I'm not so sure this is THAT kind of work. I think that's important to know. They were legally married, so if he made THAT much money, I don't think she would be worried about anything. Just because he's not IN the military doesn't necessarily mean he's over there just for the money. Look at the woman who was over there just to help provide medical care and was murdered. She wasn't wealthy.

What I'm saying is, not all of them are there for the money. Some are there to assist the military. My dad was a physicist and he assisted the military. (Not in Iraq). He was exposed to radiation and died from it. He didn't do it for the money. He was proud to work for the government and with the military. So, not everyone is there for money.

Wait a minute folks. This man that was killed apparently was NOT a military guy. He was over there voluntarily as a civy who was trying to get rich quick. These kinds of jobs pay very well and it's cuz they are loaded with danger of death and or worse. This was a decission he made, probubly with the blessings of his wife. Makes one wonder, surely being aware of the danger and the problems that could happen if he was killed, in what would happen to the wife and kid. Was this a brain fart ...or was it desperation?
Makes me wonder also, maybe this guy couldn't get a job in the USA to support his wife and kid cuz the job went to some illegals from wherever.
I am sorry for these people but somewhere along the line, someone wasn't thinking very clearly. Why go into harms way with this kind of dicey deal for the wife ...and then there is the child.
This is not good planning but I suspect it is a good example of the many different ways that illegal immigration can cause many different kinds of problems for all Americans ...and those legal immigrants that want to come here legit. People do foolish things when they are desperate. I suspect this sad story is a good example of that.

She isn't considered a statue of liberity, American born woman are the only ones that bear children into freedom.If she has been in the usa for a year or more that is enough time for her as well as her husband to apply for her citizenship. America has the right to deport her back to the country that she holds citizenship with. Since she isnt no longer married to american she will be consider a illegal immigrate.

we are missing the boat folks her husband IS not in the US military>>>> went to Iraq as civilian contractor to make big money>>>... if she was legally married and he had sponsored her with the i 130 and she entered legally then regardless of her husband death she would still be entitled to stay permanently in the States it wasn't her fault the husband died in Iraq or by natural causes there's more to this then whats asked

nothing has been done yet. Her lawyer will win the case.
This is an Immigration fear thing. Currently she is still in the US and can easily get another petition and complete her naturalization. I realy do hope all works out for her.
My guess we will hear nothing more about this because it will work out for her. Sad that they would not do a follow up saying she got to stay, but would make it frontpage news she had to go.

I'll tell you what I'm Anti Illegal but that's Complete BS in my book. Her Husband Lost his life fighting for the US and Now they have the nerve to ask his wife to Leave O Hell No. As I said at the begining I'm anti Illegal but I would sign Any petition to make it so this woman and her child can stay here. I believe if Congressmen are contacted something Surely can be done to reverse this travesty of Justice.

She is not illegally here because she had married this guy and accepted by the law of Florida. I don't know the legality term of marriage if its two years. However, I do know that after three years of marriage if all her documents are in order she can become a citizen. Maybe her family and friends should start a petition to try and get her to stay here.

2 years is a long time, if they were legitimately married, it only takes 6 months to a year to apply and get her green card.
My husband got his in 6 months and after being a permanent resident for 3 years he can apply for citizenship. only a year and a half yet.

That's horrible... this war is just creating so many problems, and it's so useless. I wish she was able to stay, it's not fair for her she had to deal with the death of her husband, and now be sent back, especially since their son was born there too.

Was he in the army? Because if so she definitely should be given permenant residence. If she was here legally, I still think we should bend over backwards on this one. If she was here illegally, then that was really her doing, wasn't it?
