You should have unisured motorist's on your policy which mean in your case if someone hits you and they don't have insurance than your campany will pay. Every company I;ve ever dealt with have had me take that out as it was part of my insurance. I would look into your policy again and don't understand why they would not cover you and than your company would pay the damages and than go after the person who hit you and make them make payments back to them until damages are paid. If for some reason you aren't covered than you will have to get an attorney and have him go after this person who hit you. After that I'd be sure to get rid of the insurance company you have and get a new one as like I said they all have always covered me for what is titled under or uninsured motorists which is if they don't have enough coverage or in your case none at all. Be sure to recall your company and ask why they won't pay.

If you don't have uninsured motorist coverage, you're pretty much in the pooper.
Talk to a lawyer. You'll have to sue the other driver in order to collect from them. That will probably only result in their losing their license until the damages are paid since most uninsured drivers don't have anything worth attaching to settle the judgement. You might get a wage garnishment if you're very lucky.
NEVER drive without uninsured motorist coverage! It's very cheap protection and would have covered you in this case.

First of all make sure you get a copy of the report from the police,also make sure you go to a doctor to get yourself check out.
It is important to make sure this is document in case you plan to sue.
I would be call my insurance company and asking why they can't pay.
If your paying for the insurance they must provide you with a valid explanation as to why. I can see since this is not your fault that your insurance company is not doing there job, go to the top after all you paid for coverage and that your in titled to a claim.
I would also consult a lawyer in suing the other party,for damages,you might also have what we have where i live is something call unsatisfied judgment, a fund that is collected by insurance company's to give the victim you in this case money towards your car,granted it is not always alot but something .
Anyway start with the insurance demand and explanation what the point of having insurance if its not there when you need it.

Other driver is financially responsable for all damages to your car. If he was not insured it is up to you to collect money from him. Attorney can help but will cost you. If your damages less than $5,000.00 file claim in small claims court, if more - hire a an attorney.
Before you do anything, try to contact this driver and see if he is willing to pay. Document everything.

Well it sounds like you don't have uninsured motorist and if that is the case you are screwed. I mean you can take them to court but I think that is your only option. Sorry.
If you need a car call the tow companies in your area most of the time they have unclaimed cars for sale. just a thought hope it helps. GOOD LUCK

If the loss is less than the maximum for a small claims court in your state (it's $5000 in most), that's what you should do rather than pay for an attorney. In either case, collecting is goint to be the hard part. On second thought, if you got the lawyer, you could maybe get a garnishment on his paycheck or a lien on his house.

I'm not sure what state you're in. Sounds like you've already checked into whether you have collision coverage with your carrier. That would pay for your damages. Also, have you asked about uninsured motorist property damage coverage? If not, ask. However, some states do not have that coverage. Otherwise, you would have to sue him in small claims court for your vehicle damage.

Since I live in CA and the law states everyone will have car insurance- I NEED TO HAVE INSURANCE COVERING UNINSURED DRIVERS! Pretty ******** sad, isn't it? You will probably have to take them to court (which, of course, will cost YOU more money). Ain't life grand?
